COMPANY AIRPORT PERMIT AND AGREEMENT

2 THIS FIRST AMENDMENT TO THE NON-EXCLUSIVE TRANSPORTATION NETWORK COMPANY AIRPORT PERMIT AND AGREEMENT (Amendment) is dated as of July 1, 2024 amends the Non-Exclusive Transportation Network Company Permit and Agreement (Agreement) entered into by and between the City of Fresno (City), and Uber Technologies, Inc. (Permittee).
RECITALS
WHEREAS, City owns and operates the Fresno Yosemite International Airport (Airport) located in the City of Fresno, County of Fresno, State of California; and
WHEREAS, the City and Permittee entered into an Agreement dated July 1, 2019, which granted Permittee with access to Airport property to provide passengers with ridesharing services; and
WHEREAS, the Agreement expires on June 30, 2024; and
WHEREAS, City and Permittee wish to amend th e Agreement to continue ridesharing services at Airport; and
AGREEMENT
NOW, THEREFORE, the parties agree to amend the Permit and Agreement as follows:
1. Article III, “TERM”, is rewritten to read as follows:
This Agreement shall have an eight-year Term beginning on July 1, 2019 and terminating on June 30, 2027. City may grant no more than two extensions of one- year each, subject to City review of all fees. This Agreement shall be subject to earlier termination with or without cause by either Party giving sixty (60) days advance written notice to the other Party.
2. Except as expressly provided in this Amendment, all other terms and provisions of the Agreement shall continue in full force and effect.
