NOTICE OF EXEMPTION

CITY OF FRESNO
Environmental Assessment

Applicant: City of Fresno
Fresno Fire Department
911 H Street
Fresno, CA 93721

Project Location: Citywide

Project Description: A mending two sections of an existing ordinance of the City of Fresno related to the City of Fresno Fire Code.

Exempt Status: The project is not subject to the requirements of CEQA pursuant to Section 15061(b)(3) of the Guidelines for California Environmental Quality Act.

Reason for
Exempt Status: The adoption of this ordinance is exempt from having to comply with the requirements of CEQA, pursuant to CEQA Guidelines Section 15061(b)(3) which states: “CEQA only applies to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA.”

This exemption is applicable as the State of California has preempted the field related to fire standards and has already adopted the California Fire Code which went into effect on January 1, 2023. There is no possibility the City’s activity in amending the provisions of the 2022 California Fire Code will have a significant effect on the environment.
