A RESOLUTION OF THE COUNCIL OF THE CITY OF
FRESNO, CALIFORNIA, AUTHORIZING THE DIRECTOR
OF PUBLIC UTILITIES OR DESIGNEE(S) TO PREPARE
AND SUBMIT GRANT APPLICATIONS, ACCEPT FUNDS,
AND EXECUTE ANY FINANCIAL ASSISTANCE
AGREEMENTS AND AMENDMENTS WITH THE
CALIFORNIA STATE WATER RESOURCES CONTROL
BOARD ON BEHALF OF THE CITY OF FRESNO FOR THE
PLANNING, DESIGN, AND CONSTRUCTION OF THE
SIDESTREAM TREATMENT SYSTEM AT THE FRESNO -
CLOVIS WASTEWATER RECLAMATION FACILITY
WHEREAS, in 2018, the Central Valley Regional Water Quality Control Board (RWQCB) made changes to the Water Quality Control Plan for the San Joaquin River Basin by adding a Salt and Nitrate Management Plan (SNMP); and WHEREAS, the City operates the Fresno -Clovis Regional Wastewater Reclamation Facility (RWRF) under Waste Discharge Requirements (WDR) Order R5- 2018-0080; and
WHEREAS, the City is addressing the nitrogen discharges at the RWRF through the Sidestream Treatment System Project; and
WHEREAS, the Project will consist of design and construction of 1) an equalization basin and deammonification reactor; 2) a process control building to house aeration blowers and electrical equipment; 3) other miscellaneous upgrades to support the integration and startup of new facilities; and
WHEREAS, the City of Fresno has demonstrated support and approval for the Sidestream Treatment System at the RWRF; and

WHEREAS, the sidestream treatment will meet the new RWQCB nitrate regulatory limits; and
WHEREAS, the City is eligible for financial assistance or principal forgiveness awarded through the California State Water Resource Board (SWRCB) Clean Water State Revolving Fund; and
WHEREAS, the City is desirous of submitting financial assistance applications to fund Sidestream Treatment System at the RWRF; and
WHEREAS, the SWRCB requires that the governing body of the applicant adopt a resolution designating an authorized representative or their designee(s) to prepare and submit financial assistance applications and execute financial assistance agreements with the SWRCB.
NOW, THEREFORE, BE IT RESOLVED BY THE Council of the City of Fresno as follows:
1. The Council of the City of Fresno authorizes this resolution.
2. The Director of Public Utilities (Authorized Representative) or designee(s) is hereby authorized to sign and file, for and on behalf of the City, a Financial Assistance Application for a financing agreement from the SWRCB for the planning, design, and construction of the Sidestream Treatment System at the Fresno -Clovis Regional Wastewater Reclamation Facility.
3. The Authorized Representative or designee(s), is authorized and designated to provide the assurances, certifications, and commitments required for the financial assistance application, including executing a financial assistance agreement from the SWRCB and any amendments or changes thereto.

4. The Authorized Representative or designee(s) is designated to represent the City in carrying out the City’s responsibilities under the financing agreement, including certifying disbursement requests on behalf of the City and compliance with applicable state and federal laws.
5. Subject to the foregoing provisions, the City certifies it has legal authority to participate in the aforementioned financial assistance programs with state and federal government.
6. Nothing in this resolution binds or obligates the City’s general fund, taxing authority, or borrowing power.
7. This resolution shall be effective upon final approval.
