RECITALS
CITY and CONSULTANT entered into an Agreement, dated February 21,2013,for professional ergineering services for the desig'n of plans and general constructiondocuments for Peach Avenue Widening Betwlen Jensen anã Bu¡er Avenues,("Agreement"); coNSULTANT has completed part one of the Agreement; and Clry and CONSULTANT now desire to modify tne scope of work, therein, byrequiring additional services.
AGREEMENT
NOW, THEREFORE, in consideration of the above recitals, which recitals arecontractual in nature, the mutual premises herein contained, and îor other good andvaluable consideration hereby acknowledge, the parties agree that the aforesaidAgreement be amended as follows:
1' CONSULTANT shall provide additional services as described inAttachment "4", attached hereto and incorporated herein by reference. The time tocomplete Part.2 of the Agreement is revised from 45 days to sé oays. 2' CONSULTANT'S sole compensation for satisfactory performance of allservices required or rendered pursuant to this Amendment shall be a total fee of$13,400.00. 3' ln the event of any conflict between the body of this Amendment and anyExhibit or Attachment hereto, the terms and conditions ót tne body of this Amendmentshall control and take precedence over the terms and conditions êxpressed withín theExhibit or Attachment. Furthermore, any terms or conditions contained within anyExhibit or Attachment hereto which purport to modify the allocation of risk between thóparties, provided for within the body of this Amendment, shall be null and void. 4' ExceÌt as othenruise provided herein, the Agreement entered into by ClTyand CONSULTANT, dated Februarv 21, 2013, remains in tull force and effect. lN WITNESS WHEREOF, the parties have executed this Amendment at Fresno,California, the day and year first above written.
