Project Description: An ordinance of the City of Fresno adopting the 2025 California State Fire Marshal (CSFM) – Fire Hazard Severity Zone Map (FHSZM) – Local Responsibility Area (LRA), dated March 10, 2025.
Exempt Status: The project is not subject to the requirements of CEQA pursuant to Section 15061(b)(3) of the Guidelines for California Environmental Quality Act.
Reason for
Exempt Status: The adoption of this ordinance is exempt from having to comply with the requirements of CEQA, pursuant to CEQA Guidelines Section 15061(b)(3) which states: “CEQA only applies to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA.”
This exemption is applicable as the State of California has preempted the field related CSFM – FHSZM – LRA areas within the City of Fresno, regardless of the City’s action. There is no possibility the City’s activity in adopting the 2025 CSFM – FHSZM – (LRA), dated March 10, 2025 will have a significant effect on the environment.
