Questions & Answers
1) Question: Does the City require a specific Certificate of Insurance format (ACORD 25) or will an insurance company certificate in any format be accepted? Answer: The City requires submission of an ACORD 25 Certificate of Insurance. Alternative certificate formats will not be accepted, as the City's insurance processing systems cannot process alternative certificate forms.
2) Question: Does FAX Maintenance have preferred delivery days/windows, or is any M-F 7am- 5pm slot acceptable with 72-hour lead time?
Answers: Deliveries are preferred between 7:00 am and 5:00 pm, Monday through Friday, as stated in the specifications. Deliveries within the 72-hour lead time window are acceptable during those hours unless otherwise authorized by the FAX Maintenance Shop Supervisor. 3) Question: The pricing form requires an 8.35% sales tax calculation. Please confirm this rate applies uniformly to all items including bulk lubricant deliveries (some states exempt lubricants from sales tax in certain industrial applications).

Answer: Yes, the rate applies uniformly.
4) Question: Regarding option year pricing: does the City's CPI adjustment process require submission of a formal adjustment request with BLS documentation, or does the City proactively notify the contractor of the allowable adjustment? Are Safety Data Sheets (SOS) required at time of bid submission, or only upon request after award?
Answer: For option year pricing adjustments, the Contractor may submit a formal request with supporting CPI documentation in accordance with the Special Conditions. All adjustments are subject to City review and approval. SOS documentation is not required at bid submission but may be requested prior to product delivery/acceptance.
5) Question: Is the contract anticipated to be a single-vendor award, or could it be split across line items by product category?
Answer: The City anticipates awarding a single contract to the lowest responsive and responsible bidder; however, the City reserves the right to reject any and/or all bids and make awards in the manner deemed to be the best interest of the City.
6) Question: Please confirm the underground storage tank (UST) capacity for Gear Oil. The specifications list engine oil UST at 7,000 gal and ATF UST at 6,000 gal, but no UST capacity is listed for Gear Oil. How is S0W-90 stored (drums only, or tank)? Answer: Gear Oil- GL-5 SAE B0W-90 is anticipated to be supplied in 55-gallon drums only. 7) Question: For Item 4 (Gear Oil GL-5 SAE S0W-90 in 55-gallon drums), does the city have a drum return or empty-drum pickup expectation, or is disposal the City's responsibility? Answer: Disposal of empty drums will be the responsibility of the Contractor unless otherwise agreed upon at the time of delivery.
8) Question: For Item 1 (Bulk CNG 1 SW-40, Cummins CES 20092), is delivery expected via meter equipped bulk tanker only, or would a direct pump-from-tote-to-UST method be acceptable? Answer: Meter equipped bulk tanker delivery is preferred for bulk deliveries. However, equivalent delivery methods capable of safety transferring product into City storage system may be accepted subject to City approval.
9) Question: Please confirm: is the 72-hour delivery window measured from initial notification, or from the issuance of a formal purchase order?
Answer: The 72-hour delivery timeframe begins upon City notification or release of goods against the Contract.
10) Question: Is the bidder required to provide a separate availability or allocation clause confirming product availability during periods of industry-wide supply constraints for Group Ill base oil or CNG-rated formulations?
Answer: No separate availability or allocation clause is required at bid submission. The Contractor must notify the City promptly of any delays affecting product availability. 11) Question: The bid specifications do not contain a force majeure clause. Will the City consider adding a force majeure provision to protect suppliers from liability for delivery delays caused by events beyond their reasonable control (e.g., supply chain disruptions, carrier unavailability, natural disasters)?
Answer: The Solicitation includes provisions under the "Delivery and Extensions" section of the General Conditions addressing delays caused by conditions or events beyond the reasonable control of the Contractor, including supply chain and carrier related delays, subject to written notification.
