DISCUSSION
California’s Assembly Bill 361 allows local agency legislative body members to participate remotely in meetings during a declared state of emergency through December 31, 2023, provided local agencies comply with specified requirements. City Council adopted Resolution No. 2021-73 on October 5, 2021, making the legally required findings to continue to authorize remote legislative body member participation for City Council and Fullerton board / commission / committee meetings and continues to make the determination every 30 days from the initial determination while the emergency exists.

The resolution does not define who has authority to determine when the emergency necessitates requiring the public participate virtually in legislative body meetings or when to hold a completely virtual legislative body meeting with no one, including legislative body members, present in the Council Chamber.

Due to the most recent COVID-19 surge, the Mayor and City Manager determined to allow virtual public participation for all legislative body meetings through February 15, 2022 but would consider allowing in-person participation as early as the end of January 2022, if health and safety conditions related to the current Omicron variant improved.

Staff recommends City Council formally authorize the Mayor and/or City Manager to determine the necessity for and format of teleconferenced legislative body meetings. Staff also recommends that any determination apply to all legislative body meetings.
