RESOLUTION NO. 2022-XXX – A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FULLERTON, CALIFORNIA, ADOPTING A LIST OF PROJECTS FOR FISCAL YEAR 2022-23 FUNDED BY SB 1: THE ROAD REPAIR AND ACCOUNTABILITY ACT OF 2017

PRIORITY POLICY STATEMENT
This item matches the following Priority Policy Statement:

Infrastructure and City Assets.

FISCAL IMPACT
The current estimate for Fiscal Year 2022-23 SB-1 revenue to the City of Fullerton totals $3,178,282.

The City will use RMRA funds to cover the $1,100,000 preliminary estimated roadway project cost for Associated Road. The Water Fund will fund costs for the water main replacement. The Sewer Enterprise Fund will fund costs for sewer main repairs.

The preliminary estimated roadway project cost for Orangethorpe Avenue totals $2,150,000, funded entirely from RMRA funds. A portion of the street right-of-way is located within the City of Anaheim. Anaheim will contribute the estimated $300,000 of work completed within their right-of-way. The Sewer Enterprise Fund will fund costs for the sewer main replacement.

The Fiscal Year 2022-23 Capital Improvement Program will include allocations to fund both projects

DISCUSSION
The Governor signed Senate Bill 1, known as the Road Repair and Accountability Act of 2017 on April 28, 2017, which developed the Road Maintenance and Rehabilitation Account (RMRA) funds to address basic road maintenance, rehabilitation and critical safety needs on both state highways and local streets. RMRA revenues derive from fuel excise taxes, diesel fuel sales taxes, vehicle registration fees and include annual inflationary adjustments. The State Controller distributes and apportions funds based on existing protocols. The current Fiscal Year 2022-23 revenue estimate for the City of Fullerton totals $3,178,282.

Unlike the annual Gas Tax revenues which the City receives directly, the City must take two supplemental steps to receive the RMRA funds:

The City must submit an executed City Council Resolution to the California Transportation Commission that identifies the new and carryover projects funded with RMRA funds.

The City must maintain programmed general fund expenditures for street, road and highway purposes. The minimum Maintenance of Effort (MOE) spending is based on the annual average of general fund expenditures during the 2009-10, 2010-11 and 2011-12 Fiscal Years.

The City of Fullerton’s three-year average MOE expenditure benchmark requirement for SB1 totals $2,142,925, as calculated by the California State Controller’s Office. As part of a similar mandate from OCTA and Measure M-2 Local Fair Share funds, the anticipated MOE expenditure for Fiscal Year 2021-22 totals $6,000,000, which exceeds the required amount.

The Infrastructure and Natural Resources Advisory Committee (INRAC) reviewed and unanimously recommended the following two projects at its February 28, 2022 meeting:

Associated Road from Rolling Hills Drive to Imperial Highway, an approximate length of 0.54 miles.

Staff will coordinate this project with water main replacement and repairs to small segments of the sewer main.

Orangethorpe Avenue from State College Boulevard to Placentia Avenue, approximate length of 0.34 miles.

Staff has not planned water main replacement for this segment of road.

The City will include sewer main replacement in this project. The Sewer Enterprise Fund will contribute costs for this work.

A portion of the street right-of-way is located within the City of Anaheim. Fullerton will partner with City of Anaheim to complete the pavement rehabilitation for the entire width of the roadway, with Anaheim contributing funding. Fullerton will serve as the lead agency.

This project will also require minor coordination with the City of Placentia.

These roadway segments make ideal candidates for rehabilitation per the Orange County Transportation Authority and its Pavement Management Program (PMP) guidelines.

The current Pavement Condition Index (PCI) scores for the Associated Road roadway segments range from 28 to 30 (Very Poor per 2020 Pavement Management Plan).

The current Pavement Condition Index (PCI) score for the Orangethorpe Avenue roadway segment is 23 (Very Poor per 2020 Pavement Management Plan).

Staff will schedule final design of the Associated Road project for completion in late 2022 and schedule construction to commence in Spring 2023.

Staff will schedule final design of the Orangethorpe Avenue project for completion by Fall 2022 and schedule construction to commence in Winter 2023, depending on weather conditions.
