RESOLUTION NO. 2022-XX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FULLERTON, CALIFORNIA, AMENDING THE CITY’S SCHEDULE OF FEES AND CHARGES FOR MUNICIPAL SERVICES PERTAINING TO THE COMMUNITY AND ECONOMIC DEVELOPMENT DEPARTMENT’S PERMIT PROCESSING AND REVIEW FEES FOR SB 9 PROJECTS WHEREAS, California State law authorizes the City of Fullerton to collect fees and charges for services, provided such fees and charges do not exceed the reasonable cost of providing such service.
WHEREAS, it is necessary from time to time to amend the City’s Schedule of Fees and revise the amounts charged to assist in the cost recovery of performing such services as cost of services can increase annually, and for other economical or defensible reasons.
WHEREAS, it is the City’s financial practice to approve and adopt fees for new processes and permits and incorporate within the City’s Schedule of Fees and Charges for the fiscal year.
WHEREAS, Senate Bill 9 (SB 9) created new processes which the City needs to add - an urban lot split fee and a Two-Unit Development fee - to the City’s Schedule of Fees and Charges for Municipal Services.
WHEREAS, in accordance with Government Code Section 66016, the City posted the cost to provide the services and the corresponding proposed user fees with Public Notices on the City’s website and at the Maintenance Services Department, Main Library, Museum Center and City Hall on the Public Notice Boards ten days prior to the public hearing.
WHEREAS, City Council held a duly noticed public hearing on May 17, 2022 relative to adoption of this Resolution.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF FULLERTON RESOLVES AS FOLLOWS:
Section 1. City Council adopts all Fees in Attachment 1 of this Resolution pertaining to Planning Division Fees and the City’s Schedule of Fees and Charges for Fiscal Year 2022-23 and amends to add the new fees.
Section 2. All prescribed Fees in Attachment 1 of this Resolution shall become effective 60 days after adoption.
Section 3. The City Clerk shall certify to the adoption of this Resolution.
