AMENDMENT NO. 1 DATED MAY 12, 2022
TO LEASE AGREEMENT 001-9053245-001 DATED MAY 12, 2022
BETWEEN CITY OF FULLERTON, CALIFORNIA
AND DELL FINANCIAL SERVICES L.L.C.
THIS AMENDMENT NO. 1 ( “Amendment”) effective as of _ ________ (“Effective Date”) is made part of and modifies the Lease No. 001-9053245-001 dated May 12, 2022 (hereinafter referred to as the “ Agreement”) between City of F ullerton, California (“Lessee”) a nd Dell Financial Service s L. L.C. (“Lessor”). Capit alized terms used in this Amendment and not defined otherwise herein shall have the meanings given such terms in the Agreement. To the extent of any conflict or inconsistency between this Amen dment and the terms and conditions of the Agreement, this Amendment will prevail.
The Agreement is hereby modified as follows:
1. Section 2. “Acceptance, Entire Agreement, Delivery, Electronic Signatures and Records:”
Restate Subsection (e) of Section 2 as follows:
“YOU AGREE THAT THIS LEASE THAT THIS LEASE WILL BE GOVERNED BY
THE LAWS OF THE STATE OF CALIFORNIA AND YOU CONSENT TO T HE
JURISDICTION OF ANY COURT LOCATED WITHIN THAT STATE AND YOU EXPRESSLY WAIVE THE RIGHT TO A TRIAL BY JURY;”
Except as amended hereby, the A greement is restated and shall remain in full for ce and effect.
