DISCUSSION
Background
Goodman Logistics Center Fullerton requested a Major Site Plan to develop overflow truck trailer parking for the previously approved Goodman Logistics Center Fullerton Project (hereinafter “GLC Fullerton Project” or “Approved Project”). The Approved Project did not include the Project site located south of and adjacent to the previously approved Building 4. The project site included an approximately 24,600 square foot single-story multi-tenant commercial / industrial building which GLC Fullerton demolished after acquiring the property. The proposed project involves site improvements and construction of a surface parking lot, an allowed use under the existing M-G ES zoning designation. The applicant would not locate structures on the project site.
The proposed project meets all applicable development standards per Fullerton Municipal Code (FMC) Section 15.47.040.B, The use is permitted by right in the zone and meets the design criteria specified in 15.47.060. The project design blends well with the adjacent and previously approved GLC Fullerton Project and existing surrounding uses, as detailed in the findings and facts contained in the Resolution (Attachment 2).
CEQA
The Project expands the previously approved GLC Fullerton Project which has a certified Final Environmental Impact Report (EIR) (SCH No. 2020031172) and an Addendum to the Final EIR prepared for the Project. Staff concluded that if the City approved the proposed Project, it would not result in any new significant environmental effects requiring major revisions to the Final EIR nor does the project have changed circumstances or substantial changes that require major revisions to the Final EIR. Mitigation measures from the Final EIR remain feasible and would adequately address the proposed Project’s potential environmental impacts and shall be applied to the proposed Project.
Planning Commission
The Planning Commission considered the requested Major Site Plan on May 11, 2022. Only the Appellant spoke against the project during the public hearing. After discussion between Commissioners and staff, the Planning Commission voted unanimously to approve the request for a Major Site Plan with the following amendments.
The applicant shall remove the existing northernmost driveway along State College Boulevard, although the applicant may widen the southern driveway, if such widening would not be contrary to the public interest, as determined by the Director of Public Works. The applicant shall replace the northernmost driveway with a standard code-compliant sidewalk, along with standard code-compliant curb and gutters.
The applicant may not use the property as a parking lot until installing a functioning gate operated at the perimeter of the property which gate shall prevent any person from entering the property from State College Boulevard. Such gate must remain closed except while a vehicle actively exits the property via that gate.
Appeal
A member of the public, Jane Reifer, has filed an appeal for City Council consideration pursuant to Fullerton Municipal Code Section 15.70.060. The Appellant’s request generally states that the City did not adequately analyze the environmental impacts of the proposed project (Attachment 4).
