APPLICANT: BLAIR DAHL, GOODMAN
PROPERTY OWNER: GOODMAN LOGISTICS CENTER, FULLERTON LLC WHEREAS the City received an application for a Major Site Plan to construct a trailer yard on property zoned M-G ES, more specifically described as Orange County Assessor’s Parcel No. 073-120-27.
WHEREAS the Planning Commission of the City of Fullerton, in compliance with the noticing requirements of Fullerton Municipal Code (FMC) Chapter 15.76, held a duly noticed public hearing for ZON-2021-0102.
WHEREAS the Planning Commission approved the request for a Major Site Plan.
WHEREAS, The City received an appeal of the Planning Commission decision to the City Council pursuant to FMC Section 15.76.170.
WHEREAS, City Council heard the appeal of the Planning Commission action (ZON-2022-0061) in a duly noticed public hearing pursuant to FMC Section 15.70.060.B.
WHEREAS FMC Section 15.47 establishes the criteria to consider in evaluating a Major Site Plan request and authorizes City Council to approve a project when it can make applicable findings.
WHEREAS, in accordance with the California Environmental Quality Act (CEQA) the Project is an addition to the previously approved Goodman Logistics Center, Fullerton, Project (hereinafter “GLC Fullerton Project”) which has a certified Environmental Impact Report (SCH No. 2020031172) and the City of Fullerton prepared an addendum to the previously certified EIR.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF FULLERTON RESOLVES AS FOLLOWS:
In all respects as set forth in the Recitals of the Resolution.
City Council, pursuant to Fullerton Municipal Code Section 15.47.040.B.2, finds as follows:
Finding: The use is permitted in the zoning classification.
Fact: The proposed Project involves the construction of a surface parking area to store truck trailers, which is an allowed use under M-G-ES, Manufacturing General, Emergency Shelter Overlay, per Fullerton Municipal Code Section 15.40.020.D.
Finding: The project meets all applicable development standards.
Fact: Staff has reviewed the project and determined it conforms to the development standards contained in Title 15 of the Fullerton Municipal Code for M-G zoned properties.
Finding: The project meets the design criteria as specified in Section 15.47.060, as applicable.
Finding: The proposed project creates a development that is pleasant in character, harmonious with past development of Fullerton and illustrates design compatibility with the desired developing character of the surrounding area.
Fact: The screen walls have been designed to complement the architectural design of the industrial building facades from the previously approved GLC Fullerton Project and existing surrounding uses. The proposed Project would include 14-foot-high concrete screen walls along the entire southern boundary of the Project site; 75-feet along the easterly side of the northern site boundary; and, along the eastern boundary of the parking area.
Finding: The proposed project includes designing and/or screening all rooftop mechanical and electrical equipment as an integral part of the building design.
Fact: The proposed Project involves demolition of the existing building and site improvements, and construction of a surface parking area. No structures would be located onsite and, as such, mechanical equipment is not being proposed.
Finding: The Project screens exterior trash, storage areas and service yards from view of nearby streets.
Fact: The Project includes constructing 14-foot-high screen walls that would screen the truck trailer storage from State College Boulevard and the adjacent properties.
Finding: That the Project minimizes noise within the project as well as noise created by the proposed project that may negatively impact the surrounding area.
Fact: As evaluated in the EIR Addendum (Noise, EIR Addendum Section 4.13), the project would not expose persons to or generate noise levels in excess of standards.
Finding: That the project creates traffic patterns that minimize impacts on surrounding properties and streets and accommodate emergency vehicles.
Fact: As evaluated in the EIR Addendum (Transportation, EIR Addendum Section 4.17), the proposed Project would not result in new or substantially more severe Project or cumulative transportation impacts than what was analyzed and disclosed in the 2020 Final EIR, and there would be no substantial change from the previous analysis in the 2020 Final EIR. Additionally, impacts to the surrounding streets would be less than significant by implementing the applicable mitigation measures from the 2020 Final EIR:
Applicable 2020 Final EIR Mitigation Measures:
The following mitigation measures from The Fullerton Plan EIR and included in the 2020 Final EIR are applicable to the proposed Project: MM AQ-6 and MM HAZ-5.
The following mitigation measure from the 2020 Final EIR, which consolidates The Fullerton Plan EIR MM AQ-6 and MM HAZ 6, is applicable to the Proposed Project: MM 11-1.
Finding: Designing landscaping to create a pleasing appearance from both within and off the site.
Fact: Although, the M-G zone only requires a 10-foot street setback, the project proposes a 20-foot landscaped street setback along State College Boulevard to coordinate with the approximately 20-foot landscaped street setback of GLC Fullerton building four, to the north of the project site.
Finding: The Project ensures that all landscaping and its corresponding irrigation systems will conform to HYPERLINK "https://codelibrary.amlegal.com/codes/fullerton/latest/fullerton_ca/0-0-0-24090" \l "JD_Chapter15.50" Chapter 15.50 of this title.
Fact: The Project has been conditioned for landscape plans to be submitted prior to issuance of building permits, in accordance to Chapter 15.50.
ADOPTED BY THE FULLERTON CITY COUNCIL ON JULY 5, 2022.
