SUMMARY
The Orange County Grand Jury released a report on the Orange County Power Authority (OCPA) with findings and recommendations requiring response from both the OCPA and each member agency.
RECOMMENDATION
Depending on its desire, City Council has the following options:
Receive and file this report.
Discuss changes to the response letter.
Take other action at City Council’s discretion.
CITY MANAGER RECOMMENDATION
The City Manager recommends City Council approve submitting the attached letter as the City of Fullerton’s response to the Grand Jury Report.

BACKGROUND
The Orange County Power Authority (OCPA) was established in 2019 to deliver cleaner electricity generated from non-fossil fuel sources and cheaper electricity through the introduction of competitive choice into the local energy market. The City of Irvine provided the initial startup capital. The City of Fullerton joined OCPA in November 2020, along with the cities of Buena Park and Huntington Beach and the County of Orange. A Board of Directors governs the OCPA, made up of one director from each member agency, except for Irvine which has two board positions until OCPA has repaid its initial capital investment in full.
DISCUSSION
The Orange County Grand Jury released a report on the Orange County Power Authority on June 24, 2022. The report identified the City of Fullerton as a member agency of OCPA and requires the City to respond to a finding and recommendation on their report.
Staff has attached the response letter to this agenda report.
