FISCAL IMPACT
The FY 2022-23 CIP Budget Drainage Capital Outlay Funds have funding available for this project. Staff recommends a $332,300 budget transfer from Project 52591 Annual Storm Drain Repair to Project 52021 Norby Lane Storm Drain Replacement Project.

Staff has attached a budget Data Sheet / Summary of Bids and the Contractor’s Bid Schedule for reference (Attachments 1 and 2, respectively).

DISCUSSION
The resident at 1101 Norby Lane reported issues with a storm drain to Public Works in March 2022. Attachment 3 shows the pipe location in the public utility easement between 1100 and 1101 Norby Lane. Staff video-inspected the pipe and confirmed that the existing pipe partially collapsed and needs replacement. Pipe replacement will allow storm water to flow properly from the street to the rear of the property and prevent potential erosion and property damage.

The age, condition, configuration and material of the existing pipe made the repair and lining the pipe an unviable option. Construction will involve excavating within the easement to remove the existing pipe and install new pipe, outlet structure and erosion control measures. Construction will also involve removing private improvements within an easement on private property including landscaping and a portion of the resident’s concrete patio. The Engineering Division has a policy to remove, but not replace, private property improvements in conflict with the project scope of work. This policy eliminates City responsibilities for workmanship concerns and/or liability issues related to the private improvements. Staff has coordinated with the property owner who has agreed to the proposed repairs.

The City received three bids for the Norby Lane Storm Drain Replacement Project on September 9, 2022. Aguilar & Calderon Corp. of Whittier, CA submitted the lowest responsible bid totaling $236,315.38. The low bid, as submitted, is approximately 11.5% below the engineer’s $299,900 estimate. Staff has reviewed the bid documents and considers them acceptable. Staff recommends awarding the contract to Aguilar & Calderon Corp. Staff expects construction to start in October 2022 and complete in December 2022.

Staff has prepared an environmental assessment in accordance with the California Environmental Quality Act (CEQA) guidelines and determined that the project is categorically exempt.
