RESOLUTION NO. 2022-XXX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FULLERTON, CALIFORNIA, AUTHORIZING THE CHIEF OF POLICE TO ACCEPT GRANT FUNDS FROM ACOHOLIC BEVERAGE CONTROL WHEREAS, the Fullerton City Council desires to undertake a certain project designated as Fullerton Police Department FY 2022-23 Alcoholic Beverage Control Grant Program, funded the California Office of Traffic Safety’s National Highway Traffic Safety Administration and administered by the Department of Alcoholic Beverage Control (hereafter referred to as ABC).l NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF FULLERTON RESOLVES AS FOLLOWS:
1. City Council authorizes the Chief of Police of the City of Fullerton to execute the contract on behalf of the Fullerton City Council, including any extensions or amendments thereof and any subsequent contract with the State in relation thereto.
2. City Council agrees that the grant recipient and authorizing agency accept any liability arising out of the performance of this contract, including civil court actions for damages. The State of California and ABC disclaim responsibility for any such liability.
3. The City of Fullerton will not use grant funds received through this grant to supplant expenditures controlled by this body.
4. City Council agrees that this award is not subject to local hiring freezes.
