SUBJECT: RESOLUTION OF PUBLIC INTEREST AND CONVENIENCE DECLARING CITY’S INTENT TO SELL REAL PROPERTY AT 212 east santa fe aveNUE for construction of a multi-use development
SUMMARY
This action would declare the City’s intent to convey property at 212 East Santa Fe Avenue and fix a time and place to hear any protests to the disposition, take final action on the disposition of the Property and approve the Disposition and Development Agreement.
RECOMMENDATION

RESOLUTION NO. 2022-XXX - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FULLERTON, CALIFORNIA, FINDING THAT THE PUBLIC INTEREST AND CONVENIENCE REQUIRE SALE OF PROPERTY LOCATED AT THE SOUTHWEST CORNER OF EAST SANTA FE AVENUE AND SOUTH POMONA AVENUE, IDENTIFIED AS APN 033-030-18 AND COMMONLY KNOWN AS 212 EAST SANTA FE AVENUE AND DECLARING ITS INTENT TO SELL SUCH PROPERTY, DECLARING THE PROPERTY EXEMPT SURPLUS LAND PURSUANT TO GOVERNMENT CODE SECTION 54234(a)

This would represent the next step to completing the ENA with Westpark LLC.

DISCUSSION
The City has negotiated with Westpark LLC, (the “Developer”) through an Exclusive Negotiation Agreement (“ENA”) regarding the sale and purchase of City owned property located generally at the southwest corner of East Santa Fe Avenue and South Pomona Avenue, commonly known as 212 East Santa Fe Avenue and identified as APN 033-030-18.
The City owns approximately 2.05 acres of certain real property. This notice of public interest and convenience announces a public hearing on December 6, 2022 for City Council consideration to declare its intent to sell the property, declaring the property exempt surplus land pursuant to Government Code Section 54234(a) and determine whether support exists to dispose of public property for the purpose of a hotel, residential and retail project. If City Council authorizes a Disposition and Development Agreement (DDA) to authorize the sale of land, the City will process the proposed project and all associated entitlements in accordance with the Fullerton Municipal Code and the California Environmental Quality Act procedures and processes, including public outreach and public hearings with the Planning Commission and City Council.
The City would declare its intent to convey the Property pursuant to terms of the DDA (subject to a finding by the Planning Commission that the sale conforms with the City’s General Plan), fix a time for hearing any protests to the disposition, provide for publishing the hearing notice and fix the time for final action on the disposition of the Property and approval of the DDA.
