DISCUSSION
Governor Brown signed Senate Bill 3 on April 4, 2016 which revised Labor Code Section1182.12 to incrementally increase the State of California minimum wage each January through January 1, 2022, at which time it reached $15.00 per hour. Labor Code Section 1182.12(c) requires the State of California Department of Finance to determine if it should adjust the minimum wage for inflation and to calculate any increase by the lesser of 3.5% or the rate of change for the US Bureau of Labor Statistics non-seasonally adjusted United States Consumer Price Index for Urban Wage Earners and Clerical Workers (U.S. CPI-W). The Department of Finance determined that the U.S. CPI-W for the period from July 1, 2021 to June 30, 2022 increased by 7.9%. As a result, the minimum wage will increase by the lesser 3.5% to $15.50 per hour effective January 1, 2023.
To comply with Labor Code Section 1182.12 and the mandated pending minimum wage increase, as well as maintain the appropriate differential among the non-regular classifications, staff recommends most classifications receive a $0.25 to $0.50 per hour increase effective December 24, 2022.
