RESOLUTION NO. 2022-XXX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FULLERTON,
CALIFORNIA, APPROVING A SUMMA RY VACATION TO ABANDON A
CITY OF FULLERTON WATER LINE EASEME NT OVER A PORTION OF 4100 NORTH HARBOR BOULEVARD AND 4030 NORTH HARBOR
BOULEVARD
WHEREAS, the City no longer needs a waterline easement over a portion of 4100 North Harbor Boulevard and 4030 North Harbor Boulevard.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF FULLERTON RESOLVES AS FOLLOWS:
1. City Council makes this vacation pursuant to California Streets and Highways Code Chapter 8335.
2. The easement for water line purposes to vacate is located on a portion of Assessor's Parcel Numbers 296-201-10 and 296-201-12 and more particularly described in the attached Exhibit "A" and shown on Exhibit "B" and by reference made a part hereof.
3. The easement to vacate within the property described in the attached Exhibit "A" and shown on Exhibit "B" is in excess of the City's need for water line purposes and the City no longer uses and has removed the easement.
4. From and after the date of recording this resolution, the City vacates said easement within the property as described in the attached Exhibit "A" and shown on Exhibit "B" and no longer constitutes a public street or right of way, highway, public service or public utility easement.
5. The City Clerk shall record certified copy of the resolution of vacation, attested by the City Clerk under seal, without acknowledgment, certificate of acknowledgment or further proof in the office of the county recorder. The vacation is complete upon such recordation.
