FISCAL IMPACT
The City budgeted this project in the FY 2022-23 Capital Improvements Program (CIP) Budget with $350,000 of Park Dwelling Funds. However, the CIP project budget does not have sufficient funding to complete this project and requires additional funding from Park Dwelling fund balance. Staff recommends a $250,000 budget transfer and appropriation of Park Dwelling Funds (Fund 39) from fund balance to Project 54039 Acacia Park & Fullerton Greenbelt Improvement Project (Fund 74) to cover the total $600,000 project cost.
Staff has attached a Budget Data Sheet and the Contractor’s proposal for reference (Attachments 1 and 4, respectively).
DISCUSSION
Acacia Park is an 8.7-acre park located at 1636 Fullerton Creek Drive. The park amenities include walking and cycling paths, fitness equipment, picnic tables, open spaces and a playground. The City constructed the first playground in the park in 1982. The original playground had deteriorated by 2002 and no longer met safety or federal requirements. As a result, the City constructed the current playground in 2003.
The City deemed the current playground unsafe and closed it to the public in May 2022. Staff consulted with multiple playground professionals to determine the appropriate method of repair. Each playground professional determined the playground beyond repair due to the deteriorated playground surface, the poor condition of the play structure and the site no longer meeting current safety codes due to construction on two levels rather than a flat surface.
Staff held two community meetings to obtain public input regarding the new playground on October 5, 2022 and November 2, 2022 and posted two survey questionnaires on the City’s website. The City held the community meetings at Acacia Park and included several conceptual playground designs. Both meetings and surveys provided the public with an opportunity to comment and provide input on the type of playground equipment. The City used the results to create the new playground design (Attachment 3). The new playground will be located to the west of the existing playground, in the ‘turf triangle area’ of existing walkways. See Attachments 2 and 3.
The City utilizes a cooperative purchasing process to streamline the project process, schedule and adhere to the City’s procurement policies through the California Multiple Award Schedule (CMAS), which is a State list of competitively solicited bids for various products and services at predetermined established pricing for state and local agencies to procure products and services.
Under the CMAS contract #4-19-78-0095A, staff will procure all playground equipment, materials and installation services with contractor Pacific Play Systems Inc, an authorized contractor and supplier for Playcraft Systems LLC. Playcraft Systems LLC previously competitively bid its products and services and received award on the Federal General Services Administration (GSA) multiple award schedule (GSA Base Schedule #GS-03F-0076U). Public Works staff, in conjunction with Parks and Recreation, will oversee project management and work with the contractor, Pacific Play Systems Inc., to manufacture and construct the new playground. As cooperative agreements typically do not identify price rates for labor costs, there are not to exceed labor thresholds amounts established by the CMAS cooperative agreement and labor and installation costs is required to be performed by licensed professionals on manufacturer’s pre-qualified list. Further, staff will ensure contractor adheres to all applicable State labor laws, including prevailing wage and registration with the Department of Industrial Relations (DIR).
The project scope for Project 54039 Acacia Park & Fullerton Greenbelt Improvement Project will include demolition of the existing playground, demolition of adjacent walkways, grading for the new playground, new concrete walkways, irrigation modifications, turf repair / seeding and planting of new tree(s). The existing large trees will remain and the City has designed the site to minimize impacts to these trees. Pacific Play Systems will design, manufacture and install the play pit drainage, concrete edging, safety surfacing and all play equipment. The City will have responsibility for the grading plan and grading, walkway improvements, irrigation modifications, associated turf repair / seeding, new tree(s) and independent playground inspection at construction completion. City staff will prepare the improvement plans in-house and then bid the associated improvements for contractor construction. Playground equipment manufacturing will take approximately six months. City staff will manage demolishing the existing playground and constructing new walkways during that time.
Staff will begin design activities upon City Council approval and anticipates construction will begin in late Spring 2023.
Staff has prepared an environmental assessment in accordance with the California Environmental Quality Act Guidelines and determined that the project is categorically exempt.
