FISCAL IMPACT
The FY 2022-23 Capital Improvements Program (CIP) Budget includes $100,000 of grant funding. However, the City received a grant $173,761 award and staff recommends an additional $73,761 budget appropriation. An Orange County Transportation Authority (OCTA) Measure M2 Environmental Cleanup Tier 1 Grant and the Drainage Capital Outlay Fund (Fund 36) provided funding for this project.
This grant will pay for 80% of eligible construction and administration costs, with the City responsible for the remaining 20%, plus any additional project costs. Staff recommends a $42,226 budget transfer of Drainage Capital Outlay Funds from Project 52696 to Project 52697 Catch Basin Connector Pipe Screen FY 2022-23 Project (Fund 74) to supplement the project budget.
Staff attached a Budget Data Sheet for reference (Attachment 1).
DISCUSSION
The State Water Resources Control Board adopted the Statewide Trash Amendments to the Water Quality Control Plan for Ocean Waters of California on April 7, 2015 to address the significant trash pollution in California’s waters. These amendments, collectively called “the Trash Provisions,” require that cities install, operate and maintain Full Capture Systems in catch basins located within / on Priority Land Uses to effectively capture 100% of trash generated. Priority Land Uses include high-density residential, industrial, commercial, mixed urban and public transportation centers.
The OCTA Measure M2 Environmental Cleanup Tier 1 Grant Program facilitates the reduction of more visible forms of pollutants, such as litter and debris collected on roadways and catch basins, before they flow to waterways and the ocean.
City Council authorized staff to submit an application to the OCTA Tier 1 Grant Program for a Connector Pipe Screens (CPS) installation project in Priority Land Use catch basins on June 7, 2022. The application proposed installing 24 CPS and 48 Grated Inlet Trash Screen (GITS) devices in catch basins located throughout the City, including several on major arterial roadways such as Harbor Boulevard, Euclid Street and Commonwealth Avenue. The device units prevent trash that does enter a catch basin from blocking discharge pipes that connect to the storm drain system and address the Trash Provision requirements within Priority Land Uses. OCTA recommended awarding $173,761 in Tier 1 Grant funding to the City of Fullerton after review of the City’s application. The OCTA Board of Directors approved the recommended funding on November 14, 2022. The City will execute a Letter Amendment to the M2 Master Agreement to receive the funding.
The Grant requires all awarded jurisdictions meet the June 2023 timely use of funding deadline. Local jurisdictions could not to enter construction contracts prior to executing the Letter Amendment with OCTA In previous cycles. However, the OCTA Board of Directors has granted local jurisdictions pre-award authority to enter into construction contracts prior to the execution of Letter Amendment due to delays in OCTA’s application review and approval as well as the associated reduction in time to execute the agreements.
The OCTA Measure M2 Environmental Cleanup Tier 1 Grant Program has pre-qualified contractors that submitted bid prices for the various catch basin sizes. One of the pre-qualified contractors is G2 Construction, Inc. who entered into a Master Purchase Agreement with the County of Orange in March 2020 for the OCTA M2 Tier 1 Environmental Cleanup Program to offer products at a reduced cost to recipients of Tier 1 Grant funds. The City has chosen G2 Construction, Inc. for this project. G2 Construction, Inc. successfully completed projects for the City during Fiscal Year 2012-13 and FY 2014-15 installing Automatic Retractable Screens in catch basins, as well as Connector Pipe Screen (CPS) inserts in FY 2018-19, FY 2019-20 and FY 2020-21. G2 Construction, Inc. has provided excellent service and assistance during and after the installation. Staff will hold G2 Construction, Inc. responsible to continue providing the appropriate products for the scope of work outlined in the OCTA Environmental Cleanup Program Tier 1 Grant Application.
Staff recommends the City utilize the County’s Master Purchase Agreement (contract MA-080-20011478, Attachment 4) and award a $195,481 contract to G2 Construction, Inc. for installation of Catch Basin Connector Pipe Screens.
Staff prepared an environmental assessment in accordance with the California Environmental Quality Act guidelines and determined that the project is categorically exempt.
