PRIORITY POLICY STATEMENT
This item matches the following Priority Policy Statements:
Fiscal and Organizational Stability
Public Safety.
FISCAL IMPACT
Using Asset Seizure Funds to purchase police vehicles reduces the impact on the General Fund. The City receives asset seizure money in excess of $200,000 annually and may use to purchase police vehicles. Staff anticipates each vehicle purchase will not exceed $50,000 due to vehicle trade-ins offsetting costs.
DISCUSSION
City Council approved a Police Department request to replace aging unmarked vehicles using asset forfeiture funds in 2018. The Police Department requests City Council approval to use asset forfeiture funds for ongoing purchases for vehicles needing replacement and/or ready for sale to recover higher value, offsetting the replacement costs.
The City uses nearly all the annual General Fund allocation for the police fleet to replace marked police vehicles. Unmarked police vehicle replacement remains unfunded in the current budget. The Asset Seizure Fund (Fund 34) provides a one-time funding solution for the capital outlay to purchase the needed vehicles.
The Police Department Asset Seizure Fund results from narcotics seizures by Fullerton narcotics officers, often in cooperation with federal agents, processed through and shared with federal or state agencies. These funds provide important additional resources for the Police Department. The City may only use the funds for law enforcement purposes to supplement and enhance, not supplant, appropriated agency resources. Additionally, Asset Seizure Fund purchases must follow the Code of Federal Regulations (CFR) and the vendor cannot appear on the SAM.gov federal debarment listing.
Staff also requests City Council authorize an informal purchasing process recognizing the challenge to obtain three written quotes due to limited inventory availability or short timeframe requirements in order to purchase the vehicle before the vendor sells it. This request would allow the Police Department to expedite the procurement of such vehicles as needed until supply chain shortages stabilize. cc: City Manager Eric J. Levitt
