PRIORITY POLICY STATEMENT
This item matches the following Priority Policy Statement:

Infrastructure and City Assets.

FISCAL IMPACT
Staff will apply $209,770 CalRecycle grant award and $240,000 CIP funds to this project.

CalRecycle awarded the City a $209,770 grant from the Beverage Container Recycling Grant Program (RBC32: 2020-21) on April 9, 2021. This fiscal year grant award will reimburse the City for eligible expenses related to construction of trash enclosures within the southerly parking lot. Staff recommends appropriating this grant to Project 55058 Downtown Trash Enclosure - West Amerige Parking Lots.

The FY 2022-23 CIP Budget also includes funding for this project. Staff recommends a $240,000 budget transfer and appropriation of Infrastructure Funds (Fund 74) from Project 44793 Curb, Gutter and Sidewalk FY 2021-22 to Project 55058 Downtown Trash Enclosure - West Amerige Parking Lots within the CIP Fund (Fund 74).

Staff has attached a Budget Data Sheet / Summary of Bids and the Contractor’s Bid Schedule for reference (Attachments 1 and 2 respectively).

DISCUSSION
This project would upgrade the trash enclosure currently containing two bins located at the 100 Block of West Amerige Avenue parking lot in Downtown Fullerton, see Attachment 3 – Project Location Map. The surrounding businesses produce high amounts of beverage container recycling but currently lack the capacity for proper waste and recycling. Republic Services has reported chronic waste and recycling dumpster overflow in this area. The new trash enclosure would meet the goal for Assembly Bill 939 (AB 939 Integrated Waste Management Act) of providing recycling to aid in trash diversion by benefitting disadvantaged communities, reducing litter, increasing recycling practices and reducing trash sent to landfills.

The new enclosures would include a roof to reduce leachate production, concrete curbs for containment and a connection to the City’s sewer system to aid with maintenance and cleaning. In addition, the separate trash enclosures would allow the City to assign one to each property owner or business, thereby mitigating trash overflows.

The project would demolish the existing enclosure to accommodate the new, larger trash enclosure and modify the parking lot to offset the lost parking stalls due to new construction. Staff has contacted local businesses within the 100 Block of West Amerige Avenue and has received approval of the proposed trash enclosure construction and parking lot modifications. In addition, the City’s Board of Parking Places, also known as the Transportation and Circulation Commission (TCC), approved the proposed improvements.

Staff released the project with a base bid scope of work and an optional additional bid alternative due to available funding concerns at the time of bidding. The base bid involves demolishing the existing trash enclosure, construction of the new enclosure and modification of the public parking lot in the southerly West Amerige Avenue parking lot only. The scope of work for the bid alternate is similar to the base bid and includes demolishing the existing trash enclosure and constructing four trash enclosures in the northerly parking lot. See Attachment 3 for base bid and bid alternate locations.

Staff recommends including the bid alternate and upgrading the existing trash enclosure located in the northerly parking lot. The existing trash enclosure at this location meets the project goal by improving trash collection within a high traffic disadvantaged community by reducing trash overflow, improving recycling practices and reducing collection frequency. No loss to parking lot stalls will occur at the north parking lot location.

The City received five bids on April 6, 2023 for Downtown Trash Enclosure – West Amerige Parking Lots Project. Golden Sun Firm & Co from Van Nuys submitted the apparent lowest base bid in the amount of $154,636 and $130,386 for the alternate bid. Staff evaluated the bids and found them acceptable. The low base bid was approximately 3.75% above the $150,000 engineer’s estimate. The alternate bid was approximately 2.73% below the $135,000 engineer’s estimate. Staff recommends awarding the project to Golden Sun Firm & Co.

Funding for the project includes a grant from the California Department of Resources Recycling and Recovery (CalRecycle) which awarded $209,770 to the City from the Beverage Container Recycling Grant Program (RBC32: 2020-21). City Council accepted this grant award on April 9, 2021 and authorized acceptance of CalRecycle grant awards through FY 2024-25. City Council approval of recommendation number two authorizes appropriation of receipt and use of grant awards for this same period.

Staff expects the total costs eligible for grant reimbursement to equal less than the $209,770 grant award based on current project design costs, construction bid costs, plus construction management and inspection costs. The City would use Infrastructure funds to cover any grant-ineligible costs. Staff will coordinate with CalRecycle to include the bid alternative work as an eligible cost. The City will work with CalRecycle to identify an alternate grant eligible project to apply any unexpended grant funds.

Staff anticipates construction will begin and end in early summer 2023.

Staff has prepared an environmental assessment in accordance with the California Environmental Quality Act Guidelines and determined that the project categorically exempt.
