SUBJECT: DAY OF MUSIC COMMITTEE FEE WAIVER REQUEST
SUMMARY
The Day of Music Committee requests City Council waive all fees (except Police fees) for their annual music festival event. Last year, City Council waived all fees except for Public Safety personnel reimbursement costs.
RECOMMENDATION
City Council could waive the following Day of Music fee waiver requests, consistent with City Council action last year:
Fees for Use of Facilities $2,530
Fees for City Expenses $1,520
Refundable Deposits $750.
CITY MANAGER REMARKS
The City Council waived the above fees last year, and had the event pay for Public Safety personnel costs. Due to the nature of the event, I recommend that the City Council waive all fees except Public Safety personnel consistent with last year’s action.
Alternatively, the City Council could pull the consent item and only waive the Use of Facility fees ($2,530).
PRIORITY POLICY STATEMENT
This item matches the following Priority Policy Statement:
Fiscal and Organizational Stability.
FISCAL IMPACT
The Day of Music Committee would incur fees for use of facilities and direct City expenses, in addition to the refundable security deposit. The facility use fees for this event total $2,530. Facility use fees support maintenance and operation of city facilities. The City would incur $1,520 direct costs for part-time staffing, custodial and plaza cleaning. The City would fully refund the security deposits as long as no damage requires application of the deposit fees. The Parks and Recreation budget does not include funding for this event.
DISCUSSION
The Day of Music Committee has hosted an annual City-wide music festival for the community on June 21, the first day of summer, since 2015. The number of Day of Music venues has expanded over the years to include parks, public areas, streets, private businesses and the Downtown Plaza. The Committee plans to hold a scaled-down event this year at a single location in the Downtown Plaza, similar to the 2022 event, and requests permission to close Wilshire Avenue. This event would feature three stages - one on the Downtown Plaza and two on Wilshire Avenue.
The Day of Music Committee asks the City to waive all fees, except for Police, and have City staff assist with closing Wilshire Avenue and event set up and teardown. The Parks and Recreation Department does not have enough full-time or part-time employees to provide planning and coordination of the Day of Music Committee event. Re-directing staff and funding to support Day of Music would negatively impact the full roster of programs and services provided by the Parks and Recreation Department. The Day of Music Committee would conduct event planning and operation, including securing and contracting vendors, food trucks, music entertainment and event supervision.
The following lists rental fees for the Fullerton Downtown Plaza event:
