SUBJECT: ASSOCIATED ROAD STREET IMPROVEMENTs yorba linda to bastanchury contract award
SUMMARY
Request to direct City Manager to award and execute a construction contract with an approved contractor for street improvements on Associated Road from Yorba Linda Boulevard to Bastanchury Road.
RECOMMENDATION
Approve plans and specifications for Project 44060 Associated Road Street Improvement project.
Authorize City Manager to award and execute a construction contract not to exceed $650,000 with an approved contractor for Project 44060 Associated Road Street Improvement Project (Fund 74), in a form approved by the City Attorney.
Authorize City Manager to conduct a public hearing to hear bid protests if any protests submitted.

FISCAL IMPACT
The Fiscal Year 2022-23 CIP Budget has funding programmed for the project provided by the Orange County Transportation Authority (OCTA) 2021 Pavement Management Relief Funding (PMRF) and local street funding sources. The City received $409,362 one-time PMRF eligible for construction costs only. The City would provide design and project approval costs, plus any costs above the $409,362 PMRF. Staff would return to City Council to report and authorize actual budget transfer amounts.
DISCUSSION
City Council approved funding improvements on Associated Road between Yorba Linda Boulevard and Bastanchury Road with the OCTA 2021 PMRF allocation on November 16, 2021. The improvements include sidewalk repair, cross gutters, alley returns, curb ramp construction and street pavement rehabilitation. Associated Road pavement conditions rate between Poor and Fair (PCI scores of 44 and 65 respectively).
California State University, Fullerton (CSUF) is adjacent to the project limits with Associated Road providing a primary campus access. Staff programmed construction activities during the CSUF summer recess (June through mid-August) to take advantage of the reduction in student traffic volume (vehicular, bicyclist and pedestrian) as well as a lower public daily traffic volume.
The Federal Coronavirus Response and Relief Supplemental Appropriations Act of 2021 (CRRSAA) funds the PMRF Program, subjecting the funds to federal requirements and regulations including obtaining project approvals from Caltrans before releasing the project to bid. Staff completed project design and initiated the process to secure Caltrans approval in Fall 2022. The volume of agencies submitting applications to Caltrans has generated unusual processing delays. Caltrans anticipates final approval within the next several weeks. Bid opening to City Council award to contract completion typically takes several months. Staff requests City Council authorize the City Manager to enter into a construction contract with an approved contractor to provide the contractor with the maximum timeframe to complete this project by mid-August 2023.
The City would competitively bid this project pursuant to the Public Contract Code, Fullerton Municipal Code and federal funding requirements. The City would post this project a minimum of three weeks following Caltrans authorization. Staff would review all bids, recommend contract award to lowest responsible bidder and return to City Council with notification of the contract award and project costs and request budget transfer authorization.
