PRIORITY POLICY STATEMENT

Infrastructure and City Assets.

FISCAL IMPACT
Entering into Amendment No. 1 to extend the agreement term with AGA Engineers, Inc. generates no fiscal impact. The Fiscal Year 2022-23 CIP Budget has sufficient funding for Project 46000 Orangethorpe Avenue / Esperanza Road Project P Regional Traffic Signal Synchronization Program (Fund 74). Amendment No. 1 extends the AGA contract term without any additional funding request.

Amendment No. 1 would continue to contract with AGA for traffic engineering consultant services for design, system integration, construction management and ongoing monitoring and maintenance for Project 46000 Orangethorpe Avenue / Esperanza Road Project P Regional Traffic Signal Synchronization Program (Fund 74).

The Orange County Transportation Authority (OCTA) Measure M2 Project P Grant provided $3,577,600 to partially fund this project. The City of Fullerton provided $277,500 matching funds from Measure M2 Fund and Traffic Mitigation Fees. Other agencies have contributed $617,000.

DISCUSSION
The City of Fullerton is the lead agency for administration and management of this project while the cities of La Palma, Buena Park, Placentia, Anaheim and Yorba Linda and the County of Orange have agreed to fully participate and contribute their fair share of the required matching funds.

Staff solicited bids from the OCTA pre-established and pre-approved list of consultants for such projects. Staff received one bid totaling $1,283,247 from AGA on January 14, 2019 in response to the solicitation for Proposed Engineering Services per the RFP and a second bid totaling $248,134 for Additional Proposed Tasks. Staff reviewed the proposal and found the consultant qualified to complete the work. The City awarded a four-year contract on February 19, 2019.

Staff expected a four-year contract to allow time to complete all phases of the project at the time of award. However, COVID-19 created unforeseen delays and the project remains in construction with the final two-year phase, ongoing monitoring and maintenance yet to begin. Staff expects ongoing monitoring and maintenance to begin June 2023 and end June 2025.

Staff recommends amending the professional services agreement with AGA retroactively from February 19, 2023 and extend through the end of 2025 to allow time for AGA to complete the tasks identified in the original bid.
