FISCAL IMPACT
The City funded the Acacia Park Improvements project with $600,000 of Park Dwelling Funds. This amount will not cover the full cost of the project due to additional site improvement costs. Staff recommends a $115,000 budget transfer from Park Dwelling Fund fund balance (Fund 39) to Project 54039 Acacia Park Improvement Project (Fund 74) to provide the additional funding for this project.

Staff has attached a Budget Data Sheet and the Contractor Bid Schedule for reference (Attachments 1 and 2).

DISCUSSION
Acacia Park is an 8.7-acre park located at 1636 Fullerton Creek Drive. The park amenities include walking and cycling paths, fitness equipment, picnic tables, open spaces and, until recently, a playground. The City deemed the playground deemed unsafe and closed to the public in May 2022. City Council approved a contract for purchase and installation of a new playground equipment on December 20, 2022. The equipment is currently in fabrication and the City has tentatively scheduled for delivery and installation in September or October 2023.

The area around the new playground requires site improvements prior to playground equipment installation including grading, walkway replacement to meet accessibility requirements, irrigation modifications, turf repair and seeding, site lighting modifications and plumbing improvements for a new drinking fountain. Staff designed the site improvements to protect the large trees located near the project.

Staff formally bid and advertised the project in June 2023. The City received nine bids on June 29, 2023 for the Acacia Park Improvements Project. Oppenheimer National submitted the lowest responsible base bid totaling $238,680.05. The low bid is approximately 30% lower than the $337,375 staff estimate with the lower cost attributed to significantly lower concrete construction costs than expected. Staff evaluated the bid and found it acceptable and recommends awarding the project to Oppenheimer National.

The bid documents require the City to award the contract on the base bid amount. However, the project included a bid alternative for replacement of an adjacent drainage device that has significant undermining and erosion from the park site runoff during storm events. The submitted bid alternative costs $19,240.15. Staff reviewed this cost, found it acceptable and recommends awarding this bid alternative for a total $257,920.20 contract amount.

Staff prepared an environmental assessment in accordance with the California Environmental Quality Act Guidelines and determined that the project is categorically exempt.
