RESOLUTION NO. 2023-XXX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FULLERTON, CALIFORNIA, APPROVING AN APPEAL AND REVERSING THE HOUSING LOAN COMMITTEE DENIAL OF A DEFERRED HOME IMPROVEMENT LOAN WHEREAS, the City offers Deferred Home Improvement Loans to assist Fullerton residents and property owners to rehabilitate their home.
WHEREAS, pursuant to the Home Improvement Policy Guidelines, a deferred home improvement loan recipient must qualify as very-low, low- or moderate income, must have sufficient equity in their homes, cannot have family assets in excess of $20,000.00 and the assets of senior citizens cannot exceed $30,000 and must secure the City loan against the real property for which the loan was issued in no less favorable a position than a second lien.
WHEREAS, the City preliminarily approved applicants Mr. and Mrs. Gbondo for a Deferred Home Improvement Loan based upon information provided in their application on January 30, 2023.
WHEREAS, due diligence prior to disbursement of the loan revealed that applicants failed to inform the City of their ownership of two additional properties in Fullerton and Diamond Bar representing family assets in excess of the $30,000.00 limitation set forth in the Home Improvement Policy Guidelines and an existing second lien against the subject property which would place the City loan in third position.
WHEREAS, the City withdrew the preliminary applicant approval on April 4, 2023.
WHEREAS, the applicants appealed the decision to withdraw their preliminary approval.
WHEREAS, the Housing Loan Committee considered all testimony and evidence presented and upheld the Home Improvement Program decision to withdraw the applicant approval on April 18, 2023.
WHEREAS, applicants have appealed the Housing Loan Committee decision to City Council.
WHEREAS, City Council conducted a duly noticed hearing of the appeal of the Housing Loan Committees decision on August 1, 2023 at which City Council received and considered testimony and evidence, both written and oral.
NOW, THEREFORE, the City Council of the City of Fullerton hereby resolves as follows:
1. The above recitals are true and correct and are a substantive part of this Resolution.
2. City Council reverses the decision of the Housing Loan Committee and the Home Improvement Program and approves the Deferred Home Improvement Loan to applicants due to good cause shown at the appeal hearing.
3. The City reviewed this Resolution with respect to the applicability of the California Environmental Quality Act (Public Resources Code Section 21000 et seq.) (“CEQA”) and determined that the approval of the loan does not have the potential for creating a significant effect on the environment and is therefore exempt from further review under CEQA pursuant to State CEQA Guidelines Section 15060(c)(3) because it is not a project as defined by the CEQA Guidelines Section 15378. Adoption of the Resolution does not have the potential for resulting in either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment.
ADOPTED BY THE FULLERTON CITY COUNCIL ON AUGUST 1, 2023. ,
