RECOMMENDATION
Adopt Resolution No. 2023-XXX.

RESOLUTION NO. 2023-XXX – A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FULLERTON, CALIFORNIA, ADOPTING A CERTAIN CLASS SPECIFICATION IN THE PERSONNEL CLASSIFICATION PLAN AND AMENDING RESOLUTION NO. 2022-039 APPENDIX A RELATING TO COMPENSATION FOR CONFIDENTIAL / NONREPRESENTED EMPLOYEES

CITY MANAGER REMARKS
None.

PRIORITY POLICY STATEMENT
This item matches the following Priority Policy Statements:

Fiscal and Organizational Stability
Public Safety.

FISCAL IMPACT
The $1,000,000, two-year funding from Orange County Supervisor Doug Chaffee’s County discretionary funds covers program costs. Staff does not anticipate this program will have have a net fiscal impact on the General Fund (Fund 10).

DISCUSSION
City Council authorize the City Manager to sign an agreement with the County of Orange for a two-year pilot Police Behavioral Health Clinician Program on July 18, 2023. This program has clinicians respond to calls involving mental health crises, domestic violence or juvenile delinquency either in lieu of or alongside police officers.

Implementing this program requires a new classification of Police Behavioral Health Clinician Series (PBHC). Employing such professionals within the City allows the Police Department to provide more comprehensive services to those experiencing trauma related to a mental health crisis, domestic violence, juvenile delinquency or similarly related issue.

Staff patterned the proposed class specification after the County of Orange Behavioral Health Clinician positions. The series consists of two levels of PBHC – Level II and Level I. The Level II requires a California Board of Behavioral Sciences Clinical Social Worker, Marriage and Family Therapist licensed or a Professional Clinical Counselor licensed. Level I requires registration rather than licensure within these programs.

The City would consider incumbents assigned to the position “at-will” and subject to the resolution for compensation for Confidential / Non-represented employees. Municipal Code Sections 2.33.010 and 2.33.020 related to the City’s disciplinary and appeals procedures shall not apply due to the at-will status. Each PBHC serves at the pleasure of the Chief of Police and the City may discharge without cause.

Staff recommends creating two new salary ranges within Resolution 2022-039 Appendix A – Salary Range 874 ($5,852 - $7,469 approximate monthly) and 876 ($6,145 - $7,843 approximate monthly) resulting in a 5% differential between the two ranges. PBHC I will have Salary Range 874 and PBHC II will have Salary range 876.
