RESOLUTION NO. 2023-XXX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FULLERTON, CALIFORNIA, AMENDING THE PARKS AND RECREATION FEE SCHEDULE TO ESTABLISH RENTAL FEES FOR THE HUNT LIBRARY WHEREAS, California law authorizes the City of Fullerton to collect fees and charges for services, provided such fees and charges do not exceed the reasonable cost of providing the service.
WHEREAS, City Council adopted the Fiscal Year (FY) 2023-24 Master Schedule of Fees and Charges on June 6, 2023 in which staff concurrently took the Hunt Library bridge program for approval and did not include as part of the City’s Fee Schedule.
WHEREAS, the City of Fullerton has conducted an analysis of the services provided at the Hunt Library, the costs reasonably borne of providing those services, the beneficiaries of those services and the revenues produced by those paying fees and charges for special services provided at the Hunt Library.
WHEREAS, the City wishes to comply with both the letter and the spirit of California Constitution Article XIIIB and limit the growth of taxes.
WHEREAS, the City has established a policy to recover the full costs reasonably borne of providing special services of a voluntary and limited nature; such that general taxes do not divert from general services of a broad nature and thereby utilized to subsidize unfairly and inequitably such special services.
WHEREAS, the proposed fees are regulatory in nature and intended as reasonable charges for the costs incurred in renting City Property and for inspection, administration, protection of public health, safety and welfare and enforcement of the same.
NOW, THEREFORE, the City Council of the City of Fullerton resolves as follows:
City Council adopts all fees set forth in this Resolution and fees will take effect immediately.
2. This Resolution amends the City’s Master Schedule of Fees and Charges as authorized by Resolution No. 2023-037, Parks and Recreation Policy Statement and Fee Schedule, as follows:
