melissa rendon, associate engineer
SUBJECT: FISCAL YEAR 2022-23 CURB AND GUTTER AND SIDEWALK PROJECT

RECOMMENDATION
Reject all construction bids and issue a new invitation to bid.

CITY MANAGER REMARKS

PRIORITY POLICY STATEMENT
This item matches the following Priority Policy Statement:

Infrastructure and City Assets.

FISCAL IMPACT
The Fiscal Year 2023-24 Adopted CIP Budget has limited programmed funding for the Curb and Gutter Sidewalk Project (Project No. 44794). Project bids exceeded the engineer’s estimate and staff recommends re-bidding this project to attract more competitive bids and hold down project costs to support a more effective use of available funds.

DISCUSSION
The Curb and Gutter and Sidewalk Project occurs annually to repair damaged curb, gutter and sidewalks at various locations throughout the City. Staff determines the replacement locations through a combination of resident requests, information from Public Works – Maintenance Department and staff observations. The City typically completes repairs in chronological order of the request date and in coordination with other street rehabilitation CIP projects, as well as conflicting work from private utility companies.

The FY 2023-24 project will cover 113 separate locations. The City would have approximately 169 remaining reported locations to address after completion.

The City received two construction bids on August 22, 2023, shown in the following table:

RANK

CONTRACTOR

BID TOTAL
1 Addison-Miller Inc.
$685,500
2 MBC Enterprises Inc.
$919,360
The original engineer’s estimate totaled $563,500 for the FY 2023-24 project. Staff recommends rejecting all bids due to limited available budget, unusually low number of bidders, high-cost difference in bids and bids significantly exceeding the engineer’s estimate and re-bidding this project.

Staff contacted contractors on the plan holders list, in addition to contractors who specialize in this type of work, to determine why they did not submit bids. Responses ranged from the high volume of repair locations to potential issues with the third-party bidding site not correctly advertising the project bid.

Rejecting all bids would allow the City to notify additional potential bidders, confirm correct advertisement on the third-party bidding site and receive additional more competitive bids resulting in more effective use of available funds. Staff considers the cost to re-bid the project minimal as the project scope would not change. Staff anticipates completing the FY 2023-24 project in the current fiscal year. cc: City Manager Eric J.
