This item generates no fiscal impact to the City General Fund. The property owner, Chevron / Pacific Coast Homes (Chevron / PCH), maintains open space dedication areas until dedication and City acceptance of said area(s), pursuant to City Council Resolution No. 2015-62. Furthermore, property owner is obligated to fund the support endowment for operation and maintenance of trails and other public amenities within all open space dedication areas up to a defined amount.

DISCUSSION
The Vesting Tentative Tract Map (VTTM) No. 17609 authorized Chevron / PCH to subdivide 510-acre of West Coyote Hills project site for open space, residential and commercial purposes, including options for public acquisition of portions of the property or the entire project site with a purpose to protect the open space and habitat in West Coyote Hills (Attachment 1).

The Planning Commission approved VTTM No. 17609, Addendum No.1 to the Final Environmental Impact Report for the West Coyote Hills Specific Plan and Robert E Ward Nature Preserve Project on October 22, 2015 and recommended City Council approve abandonment of public easements no longer needed for public purposes.

City Council upheld the Planning Commission approval on November 17, 2015 by denying two appeals of Planning Commission decisions and adopted Resolutions No. 2015-61 through No. 2015-63 (Attachment 2).

The City pursued the purchase of Neighborhoods 1 and 3 from Chevron / PCH since approval of VTTM 17609. City Council approved a Purchase and Sale Agreement on December 17, 2019 for acquisition of 24.1 acres of open space on the east side of West Coyote Hills known as Neighborhoods 1 and 3 of VTTM 17609 (Attachment 3).

The acquisition of Neighborhoods 1 and 3 and elimination of Neighborhood 2 resulted in no residential development / associated public improvements occurring east of Gilbert Street (Attachment 4).

The Final Map for Tract No. 19275 is the first final map of four phased final maps for the VTTM 17609. The map territory is located east of Gilbert Street creating Lot 1 for future open space dedication area (Attachment 5).

Final Map for Tract No. 19275 proposes easement dedications for additional street right-of-way and public utility purposes along Euclid Street and Gilbert Street.

City Council Resolution No. 2015-63 (Attachment 2) declared its intention to abandon unneeded easements at the time of final map(s) approval. The City will abandon the unneeded slope easement dedicated to the City in 1961 (Book 5898, page 856 of Official Record) and not used for intended purposes on Final Map for Tract No. 19275.

The subdivider, Chevron / PCH, has submitted a Subdivision Implementation Agreement (Attachment 6) and all required cash fees. This Agreement will be amended to provide additional terms contemplated by the conditions of approval of VTTM 17609 prior to approval of the next final map to be filed under VTTM 17609. Future amendments to this Agreement will carry forward the timing and phasing of public benefits and improvements, support endowments, procurement of bonds and other obligations of the Conditions of Approval triggered by development or grading activities or approvals. The by City Attorney reviewed the Subdivision Implementation Agreement and found it acceptable.

Staff has reviewed and approved the Final Map for Tract No. 19275 for technical correctness and found it be in conformance with approved VTTM 17609, the Subdivision Map Act and Fullerton Municipal Code Title 16.
