SUBJECT: CONTRACT WITH CJ CONCRETE CONSTRUCTION, INC. FOR Curb AND gutter and sidewalk Project fISCAL YEAR 2022-23
SUMMARY
Award $474,100 construction contract to CJ Concrete Construction, Inc. for Curb and Gutter and Sidewalk Project 44794 Fiscal Year (FY) 2022-23.
RECOMMENDATION
Approve plans and specifications for Curb and Gutter and Sidewalk Project FY 2022-23.
Approve $202,000 budget transfer and appropriation of Drainage Capital Outlay funds (Fund 36) from Project 44795 Curb and Gutter and Sidewalk Project FY 2023-24 to Project 44794 Curb and Gutter and Sidewalk Project FY 2022-23 in the Capital Improvement Program (CIP) Fund (Fund 74).
Award $474,100 construction contract to CJ Concrete Construction, Inc. for the Curb and Gutter and Sidewalk Project FY 2022-23 and authorize City Manager, or designee, to execute the contract, in a form approved by the City Attorney.
Authorize Public Works Director, or designee, to approve any future change orders for construction and professional engineering construction support services with the approved project budget.

The Curb & Gutter and Sidewalk Project will complete 1700 LF or curb/gutter and 116,500 SF of sidewalk.

FISCAL IMPACT
The FY 2023-24 Adopted CIP Budget has funding for the project. Staff recommends a $202,000 budget transfer and appropriation of Drainage Capital Outlay Funds from Project 44795 Curb and Gutter and Sidewalk Project FY 2023-24 to Project 44794 Curb and Gutter and Sidewalk Project FY 2022-23 to complete the project.
Staff attached the Budget Data Sheet / Summary of Bids and the Contractor’s Bid Schedule for reference (Attachments 1 and 2).
DISCUSSION
The Curb and Gutter and Sidewalk Project FY 2022-23 is an annual project to repair damaged curb, gutter and sidewalks at various Citywide locations based on a list of locations in need of repair. Staff maintains the list based on a combination of resident requests, information from Public Works – Maintenance Department and staff observations. Street and/or private tree roots cause most of the damage.
The City typically completes repairs in chronological order based on request date and in coordination with other street rehabilitation CIP projects. This project covers 113 separate locations, leaving over 165 remaining reported locations to address.
City Council rejected all bids for this project on September 19, 2023 due to high costs and a low number of bidders. The City rebid the project and received six bids on October 10, 2023 for the Curb and Gutter and Sidewalk Project FY 2022-23. CJ Concrete Construction, Inc. submitted the lowest responsible base bid in the amount of $474,100. The low bid, as submitted, is approximately 16% percent below the $563,500 engineer estimate. Staff reviewed the bid documents and considers the bid acceptable.
The construction would tentatively start in January 2024 with anticipated project completion in March 2024.
Staff prepared an environmental assessment in accordance with California Environmental Quality Act Guidelines and determined the project categorically exempt.
