CITY MANAGER REMARKS
The City Manager recommends authorization to execute agreement for 2023. In addition, we have highlighted the costs for 2024.

PRIORITY POLICY STATEMENT
Not applicable.

FISCAL IMPACT
The procurement has no net General Fund impact as grant funding supports the cost. This item requires no additional appropriation. The cost for the 1,940.80 tons of SB 1383 procurement credit for compost use and all required documentation to meet the City’s SB 1383 Calendar Year 2023 (30%) Procurement Target goals totals $40,756.80. The Fiscal Year 2021-22 SB 1383 Local Assistance Grant Program (Fund 46 – Refuse Collection) includes this cost.

The term of the purchase order with Zero Foodprint expires on December 31, 2023. Staff estimates an $88,500 annual (calendar year) cost to continue to work with Zero Foodprint, should the City desire.

DISCUSSION
Zero Foodprint would support City efforts to procure SB 1383 credit for 1,940.80 tons of compost use and all required documentation to meet City SB 1383 Calendar Year 2023 (30%) Procurement Target goals. Governor Brown signed Senate Bill 1383 into law in September 2016, setting targets to reduce short-lived climate pollutant emissions. The legislation requires cities and counties to procure organic waste products, such as compost, to meet an annual procurement target (calculated by multiplying a jurisdiction population by the per capita procurement target). These procurement requirements will strengthen California’s green, self-sustaining economy. The City of Fullerton has an annual 11,154 ton procurement target.

Governor Newsom adopted Assembly Bill 1985 which allowed a phased implementation timeline to procure a quantity of recovered organic waste products (ROWP). Each jurisdiction must procure thirty percent (30%) of its ROWP target on or after January 1, 2023, sixty five percent (65%) in 2024 and one hundred percent (100%) in 2025.

City staff researched available qualifying procurement product options and considered the most beneficial and cost-effective method of compliance. Staff received three informal bids with quotes for SB 1383 procurement credit for compost use in agricultural and horticultural settings and all required documentation.
