Proposal totheCityof Fullertonfor SB1383Compost Procurement Overview:ZeroFoodprint is pleasedtosubmit our proposal totheCityof Fullertontomeet theprocurement requirements of theCaliforniaSenateBill 1383(SB1383). ZeroFoodprinthas theexperienceandnetworktooverseecompost procurement anduseinagriculturethroughout California. Our focus onregenerativeagriculturemeans thateachtonof compost procurednot onlyavoids short livedclimatepollutants, butpromotes longtermcarbonsequestrationwithinthestate, supportingthehealthof oursoil, our food, andour population.

Proposal:ZeroFoodprint will providecompost procurement andrecordkeepingfor theCityofFullertontoassist withits 2023, 2024, and2025procurement targets of at least1,940.8, 4,205.1, and6,469.3tons of compost, respectively. Our pricingfor thisprocurement will bebasedonyour budget andclimategoals. Pricingfor all threeyearsprocurement is offeredonaslidingscalerangingfrom$264,919.20to$491,992.80.

Annualizedpricingandslidingscaleinformationis availableindetail inthePricingsection.

SB1383Background:InSeptember 2016, Governor EdmundBrownJr. set methaneemissions reductiontargets for California(SB1383Lara, Chapter 395, Statutes of 2016) inastatewideefforttoreduceemissions of short-livedclimatepollutants (SLCP). EffectiveJanuary1, 2022thelawmandates that businesses andgovernments divert organicwasteawayfromlandfills andinsteadusecomposting, anaerobicdigestion, andother methods torecycleorganicwaste. As part of this effort, thelawrequires theprocurement ofcompost that meets certainspecifications.

EachJurisdictioninCaliforniais requiredtoprocurequantities of RecycledOrganicWasteProducts (ROWP) basedontheir population. Theper capitaprocurement targetequals 0.08tons of organicwasteper resident per year. TheCityof Fullerton’spopulation, calculatedat 139,431, equates toaROWPprocurement target of 11,154tons. Compost, oneof four acceptableROWPs, is valuedat thehighestequivalent–meaningthat .58tons of compost is considered1tonof ROWP. Thus the

Cityof Fullerton’s ROWPtarget canbecalculatedas 6,469.3tons of compost. (11,154tons ROWPmultipliedby.58tons of compost).

CalRecycleprovides thefollowingexplanation
1 :“Ajurisdiction’s procurement target is calculatedbymultiplyingtheper capitaprocurement target (0.08tons of organicwasteper Californiaresident per year) bythejurisdictionpopulation, as reportedbytheCaliforniaDepartment of Finance(DOF):PopulationEstimates for Cities, Counties, andtheState[see14CCRSection18993.1(c)]. For moreinformation, visit RecoveredOrganicWasteProductProcurement.

For thefirst year of compliance, 2022, jurisdictions’ procurement targets will utilizetheJanuary1, 2021, populationestimates reportedbytheDOF. Jurisdictionprocurementtargets will berecalculatedeveryfiveyears toreflect populationchanges. As such,annual procurement targets for the2022complianceyear will beineffect fromJanuary1, 2022, throughDecember 31, 2026.” InSeptember 2022, CaliforniapassedAB1985, approvingadjustments toSB1383,includingthetargets of ROWPprocurement. This Bill provides astepupapproachto100%of procurement targets, byadjustingthetargets as follows: 2023, 30%of theprocurement targets; 2024, 65%; and2025andbeyond, 100%of procurement targets.Thus theCityof Fullerton’s 2023procurement targets become3,346.2tons ROWP(1,940.8tons compost), 2024targets become7,250.1tons ROWP(4,205.1tonscompost), and2025targets become11,154tons ROWP(6,469.3tons of compost).

About ZeroFoodprint:ZeroFoodprint is aCalifornianonprofit organizationthat works tofight climatechangethroughgrowingfood. Incollaborationwithfoodbusinesses suchas restaurants andgroceries, farmers, andcommunities our workbuilds amoresustainablefoodsystem.Theorganizationwas foundedin2015withthegoal of reducingthecarbonfootprint ofthefoodindustry.

Since2020, ZeroFoodprint has focusedonregenerativeandclimatesmart agricultureas awaytodrawdowngreenhousegas emissions, andincreasethehealthof thefoodsystem. Regenerativeagricultureis anapproachtofarmingthat emphasizes soil health, biodiversity, andecosystemservices, withtheaimof enhancingthelong-termsustainabilityandresilienceof agricultural systems. Inaddition, theorganizationofferstechnical support tofarmers onhowtousecompost effectivelytoimprovesoil healthandproductivity, andpromotes theadoptionof regenerativeagriculturepractices 1 https://calrecycle.ca.gov/organics/slcp/faq/recycledproducts/ SB1383Compost Procurement for theCityof Fullerton 10/12/2023www.zerofoodprint.org morebroadly. TodateZeroFoodprint has providednearly$2Milliontofarms andranches inCaliforniatosupport theimplementationof thesepractices.

Compostingis anessential component of regenerativeagriculturebecauseit helps torebuildsoil organicmatter andimprovesoil health. It is alsoacost effectivewaytosequester CO2. This is inadditiontothereductionof greenhousegas emissions thatcomefromdivertingorganicwastefromlandfills, whereit wouldotherwisedecomposeandreleasemethane, apotent greenhousegas.

Byworkingwithlocal communities andbusinesses oncollectiveactionandfunding,ZeroFoodprint is helpingtobuildamoresustainableandresilient foodsystem.

ZeroFoodprint has providedprocurement services tonumerous Jurisdictions, completingcompost procurement andrecordkeepingontheir behalf. ZeroFoodprintis infrequent contact withCalRecycleregardingSB1383andprocurement of ROWP.This procurement programhas beendesignedtomeet jurisdiction’s needs andCalRecycle’s requirements.

ZeroFoodprint is alsoactiveinthecompost industry, includingmembershipintheUSCompostingCouncil andholdingaboardpositionintheCAAssociationof CompostProducers.

Compost Connector:ZeroFoodprint (ZFP) is uniquelypositionedtoadminister theprocurement anduseofcompost inCalifornia. Withanetworkof scores of technical experts, agriculturalorganizations, andhundreds of farms andranches throughout thestate, wehavetheexperienceandtheexpertisetoprocurecompost andutilizeit towards longtermgreenhousegas drawdown.

InresponsetoSB1383, ZFPcreatedthefarmer-facingprogramCompost Connector. This programmatches farms andranches seekingcompost withfundingfromjurisdictions interestedinmeetingtheprocurement targets.

Thereal worldcosts of usingcompost inagriculturearehigh, andthecompost itselfcanoftenbethelowest cost. Inadditiontothematerial itself, transportationandapplication. Thesecosts average$75to$100per tonof compost, onceit is hauledtoafarmandspreadonthecrops. Compost Connector reduces thesecosts for farms andranches andcreates thefinancial opportunities for additional compost use. Inmanycases ZeroFoodprint contributes its ownfunds inadditiontojurisdictionprocurementfunds toexecutethesecompost applicationprojects.

SB1383Compost Procurement for theCityof Fullerton 10/12/2023www.zerofoodprint.org Inadditiontotheprocurement services, ZeroFoodprint maintains all records of thecompost transactionanduse, providingproject level details andreporting. Thesereports will providetheCityof FullertonwithsimplecomplianceandreportingtoCalRecycle. Whenfarms andranches utilizecompost followingspecificagriculturalpracticestandards, ZeroFoodprint is abletomodel thecarbonsequestrationutilizingCOMET. MEMORANDUM DATE: June 5, 2023 TO: Honorable Mayor and Council Members FROM: Albert Stricker, Public Works Director and Steve Harriman, Operations and Maintenance Division Manager SUBJECT: A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE CONTRACT NO. 2023-XX WITH ZERO FOODPRINT IN THE AMOUNT OF $113,297 FOR COMPOST PROCUREMENT SERVICES AS REQUIRED IN STATE LAW RECOMMENDATION Adopt the Resolution. RESULT OF RECOMMENDED ACTION Adoption of the Resolution will authorize the City Manager to execute contract no. 2023-xx with Zero Foodprint (ZFP) in the amount of $113,297 for compost procurement services as required in State law. BACKGROUND Organic wastes like food scraps and yard clippings create methane gas emissions when disposed in landfills. Methane is a potent greenhouse gas which contributes to climate change. Senate Bill 1383, California’s Short-lived Climate Pollutant Reduction Strategy (SB 1383), was signed into law in September 2016 and sets methane reduction targets for California in a statewide effort to address climate change. In order to accomplish the methane reduction targets, the law requires local governments to implement programs to divert organic waste away from landfills so the materials can be used as feedstock for compost. The SB 1383 regulations also require local jurisdictions to purchase compost annually to strengthen the markets and incentivize the development of new and expanded organics processing facilities. The purchasing requirements in SB 1383 for local governments are based on a per capita calculation, and Rancho Cordova is required to purchase 1,109 tons of compost in 2023 and 2,403 tons in 2024. This is a significant amount of material given that Rancho Cordova has limited access to public or private lands for the application of these materials. Zero Foodprint (ZFP) is a nonprofit organization that assists local governments with compost procurement requirements by acting as a liaison between compost producers and farming operations for the purchase and delivery of compost manufactured from recycled feedstock. This arrangement allows local governments to comply with State law by partially funding the compost purchase and delivery expenses, and assists farmers by reducing the cost of using compost manufactured from recycled feedstock in their operations.

FISCAL IMPACT The City will pay ZFP $32.26 per ton for compost delivered to farming operations on behalf of the City of Rancho Cordova. The contract is funded by the City’s SB 1383 local assistance grant managed by the California Department of Resources Recycling and Recovery and has no impact on the General Fund. ATTACHMENT(S)
