The Fiscal Year 2023-24 Adopted Budget included the estimated $120,000 cost for this Agreement in the Refuse Fund (Fund 46). This item does not impact the General Fund.

The City’s original agreement with Republic covers reimbursement for consulting services related to SB 1383 negotiations, including a portion of the costs for this item. Staff applied for $20,000 new 2023-24 SB 1383 grant funding which can apply toward these consulting services, if awarded.

DISCUSSION
The City of Fullerton has an exclusive franchise agreement with Republic Services (aka M-G Disposal Services, LLC) to provide solid waste and recycling services in the City. The City has undertaken numerous efforts throughout the years to comply with state regulations such as Assembly Bill (AB) 341 (Mandatory Commercial Recycling), AB 1826 (Mandatory Organic Commercial Recycling) and AB 1594 (Green Material used as Alternative Daily Cover). The City has amended the franchise agreement to codify these regulations and the resulting rate changes, where applicable.

SB 1383, established by the State of California, mandates significant changes in organic waste management to reduce greenhouse gas emissions, requiring cities adopt and implement various programs to divert organic waste from landfills. City Council approved a professional services agreement with HF&H in June 2020 to lead City SB 1383 compliance and initiative efforts. The City amended the HF&H agreement in April 2021 for continued SB 1383 compliance and implementation efforts with Republic Services. The City of Fullerton is committed to complying with these regulations and seeks the continued expert assistance from HF&H Consultants to ensure successful and timely adherence.

This new consulting services agreement with HF&H Consultants represents a crucial step toward ensuring SB 1383 compliance for the City of Fullerton. The City’s established relationship as well as HF&H’s historical knowledge of Fullerton, expertise and services provided by HF&H Consultants would play a pivotal role in achieving the City's waste management goals in line with state regulations.

HF&H Consultants provided the attached proposal for Solid Waste SB 1383 Contracting Assistance in the proposed Agreement (Attachment 1), detailing the complete scope of work.
