CITY OF FULLERTON
AMENDMENT NUMBER TWO TO
ARPA SUBRECIPIENT AGREEMENT
WITH
ILLUMINATION FOUNDATION
THIS AMENDMENT is made and entered into this __ day of December, 2023 (“Effective Date”), by and between the CITY OF FULLERTON, a California municipal corporation (“City”), and THE ILLUMINATION FOUNDATION, a California Nonprofit (“Subrecipient”).
WHEREAS, City and Subrecipient entered into an agreement on November 1, 2022 for Subrecipient to provide certain services associated with sheltering homeless individuals through November 1, 2023 (the “Agreement”); and
WHEREAS, City and Subrecipient entered into Amendment Number One on November 1, 2023.
WHEREAS, the urgent need to continue to shelter individuals requires a temporary short term extension to continue service.
NOW, THEREFORE, for and i n consideration of the mutual covenants an d conditions contained herein, the parties hereby agree to amend the Agreement as follows:
1. Section 4.1 titled “Term” is amended to extend the Term of the Agreement through June 30, 2024.
2. Except as set forth in this amendment, all other provisions of the agreement shall remain the same and in full force and effect.
3. All terms not defined herein shall have the same meaning and use as set forth in the Agreement, as amended.
IN WITNESS WHEREOF, the parties hereto have cause this amendment to be executed and through their respective authorized officers as of the date first above written.
