PRIORITY POLICY STATEMENT

Fiscal and Organizational Stability
Infrastructure and City Assets

FISCAL IMPACT
No General Fund impact or additional appropriation needed for this purchase. The cost for the recycling and waste containers totals $102,975.87, which staff would purchase with Fiscal Year 2021-22 Beverage Container Recycling City / County Payment Program Grant and the Fiscal Year 2021-22 SB 1383 Local Assistance Grant Program in the Grants Fund (Fund 32).

The purchase order with CleanRiver helps the City meet the Phase I implementation goal for SB 1383 compliance. Staff estimates an additional $67,763 for Phase II costs, should the City choose to continue to work with CleanRiver.

BACKGROUND AND DISCUSSION
Governor Brown signed Senate Bill 1383 in September 2016, setting methane emission reduction targets that divert organic waste disposal from landfills. The legislation requires cities and counties to provide organic waste collection services to organic waste generators including City facilities.

The City of Fullerton has 33 facilities and 11 departments. The City will administer SB 1383 Organic Waste Collection goals in a two-phased approach. Phase I will focus on supplying departments with indoor office recycling and waste containers. Phase II will supply containers to select City facility locations with outdoor containers and continue to supply departments with indoor containers as needed. Staff programmed funds for Phase II in the Fiscal Year 2022-23 SB 1383 Local Assistance Grant application, scheduled for award in March 2024. The City could apply the $67,763 grant to this project, if awarded.

The City elected to utilize a cooperative purchasing approach to streamline the waste containers procurement process in accordance with the City of Fullerton Purchasing Policy, Administrative Policy 4.1.2 Section IV.D, which allows an exemption to the Open Market process when participating in an established governmental “Cooperative Purchasing Agreement.” Cooperative purchasing is “Procurement conducted by, or on behalf of, one or more Public Procurement Units” as defined by the American Bar Association Model Procurement Code for State and Local Governments. The agreement allows cities to procure goods and services through pre-negotiated and priced cooperative agreements with vendors without going to formal bid. The City would purchase the waste containers from CleanRiver through U.S. General Services Administration (GSA) Contract No. 47QSWA23D0052. GSA is a cooperative purchasing agency used by all sectors of government that streamlines the government procurement process and competitively solicited bids for various products and services establishing predetermined pricing for governmental agencies.

Staff reviewed CleanRiver’s GSA pricing and determined they offer a competitive rates and services. CleanRiver’s waste containers come with additional services such as custom educational casters and graphics, implementation assistance for effective performance and statistical results and benefits reports. CleanRiver also offers a 10% discounted rate on their products. Staff research revealed that CleanRiver offers a lower rate compared to other companies and provides additional services not offered by other companies.
