BACKGROUND AND DISCUSSION
City Council awarded a construction contract on August 1, 2023 to repair the existing storm drainpipe located at the South Acacia Avenue and East Valencia Drive intersection, directly adjacent to the BNSF railroad. The project included realigning the pipe away from BNSF railroad right of way, obtaining a permit from BNSF and protecting existing railroad tracks during construction. Staff coordinated with BNSF during the design process and included all known requirements in the bid documents.
However, BNSF required additional shoring requirements, outside BNSF right of way but within their sphere of influence, during the permit process which significantly increased project shoring needs. Staff directed the contractor to proceed with the additional shoring needs on a time and material basis.
The contractor completed the storm drain repair but the time and material costs for the additional work exceeded original project contingency funds. Staff requests additional funds to address this unforeseen, but required, additional scope of work noting staff would have included the additional shoring costs in the project bid documents if BNSF had informed staff of the requirement at that time. cc: City Manager Eric J.
