PROPOSED MOTION

ALTERNATIVE OPTIONS
Approve proposed motion
Other options brought by City Council.
STAFF RECOMMENDATION
Staff recommends proposed motion.
CITY MANAGER REMARKS
The City Manager recommends adoption of the recovered organic waste product procurement policy.
PRIORITY POLICY STATEMENT
This item matches the following Priority Policy Statement:
Fiscal and Organizational Stability.
FISCAL IMPACT
Staff estimates this item would increase paper office supply procurement costs by 20% and an overall cost increase to procure other organic waste materials such as compost, mulch, renewable gas, and electricity procured from biomass conversion. The current year department budget would absorb additional costs to implement SB 1383 purchasing and factored into the FY 2024-25 Budget. The City must comply with SB 1383 Recovered Organic Waste Product purchasing requirements but will evaluate environmentally preferable products and services in all procurements to ensure a reasonably competitive price.
BACKGROUND AND DISCUSSION
Fullerton must adopt this policy to fulfill SB 1383 obligations, demonstrate leadership in environmental stewardship, and contribute to statewide climate change mitigation efforts through contractual relationships and purchasing practices.
Governor Brown adopted SB 1383 in September 2016, implementing statewide organic waste recycling initiatives to meet methane emissions reduction targets while creating a diverted organic materials circular economy market. The City must follow recovered organic waste product procurement laws.
The City established a Recovered Organic Waste Procurement Policy to incorporate environmental considerations, including recycled-content and recovered Organic Waste product use into purchasing practices and procurement. This Policy supplements the Environmentally Preferred Purchasing administrative policy (Policy No. 4.1.3) and would help the City protect and conserve natural resources, water, and energy and minimize the City contribution to climate change, pollution, and solid waste disposal.
