BACKGROUND AND DISCUSSION
FMC Section 15.76 provides an appeal process in the Zoning Code. However, the Municipal Code declares any Planning Commission STR decision as final.
City Council directed staff to modify the FMC to include an appeal process for Planning Commission STR decisions. The proposed amendment would replace language declaring the Planning Commission decision as final with language to process appeals according to the Zoning Ordinance process. This would provide due process and the right to appeal Planning Commission decisions to City Council pursuant to FMC Section 15.76.
The Planning Commission voted 5 – 0 to recommended this action on February 28, 2024. No public speakers opposed the request.
