That an application was filed to consider changing the zone classification from R-1-7.2 to R-1-7.2P and R-3 to R-3P for those 92 properties described as follows:

Assessor's Parcel Nos. 031-212-16, 031-212-19, 031-224-10 through -22, 031-232-17 through -20, 031-232-22, 031-232-23, 032-061-01 through -11, 032-061-13, 032-061-14, 032-061-16 through -24, 032-062-02 through -11, 032-062-14 through -22, 032-062-25; 032-064-11 through -14, 032-064-16 through -19, 032-071-01 and 032-071-02, 032-071-07 through -09, 032- 071-11 through -16, 032-71-34, 032-071-37, 032-072-01 through -06, 032-

2. That the Landmarks Commission, after due notice thereof, duly held a public hearing on said matter pursuant to the Fullerton Municipal Code (FMC) §15.48.055 following receipt of a petition from at least 51% of the property owners in the President Avenues Neighborhood.

3. That said request is categorically exempt pursuant to Section 15308 of California Environmental Quality Act (CEQA) Guidelines.

4. That the Landmarks Commission does hereby RECOMMEND APPROVAL of changing the zoning from R-1-7.2 to R-1-7.2P and R-3 to R-3P for the subject properties as per the attached map. (Exhibit A)
That the facts and findings for recommending approval of said action are as follows:
1) The requested Zoning Amendment will assure the maintenance, restoration, enhancement and/or protection of the city's historic and cultural resources.

The proposed Zoning Amendment to add the preservation zone overlay to the existing zoning in the West Wilshire, Woods, and Wickett Square Neighborhood, one of the City's earlier developed tracts, will protect the City's stated value of historic preservation and serve to provide a method of review for improvements to residential properties within its boundaries subject to FMC §15.17.060 and the Design Guidelines for Residential Preservation Zones. 2) Adoption of the requested Zoning Amendment is consistent with the City's Zoning Ordinance and the goals and policies of the Fullerton Plan.

The proposed Zoning Amendment is consistent with the City's Zoning Ordinance which provides a process by which residential neighborhoods may request a preservation designation (FMC §$15.48.055 and 15.72). In addition, FMC §15.17.060 provides site development standards and review for residential preservation zone classifications. The City of Fullerton has previously approved Zoning Amendments to create ten (11) preservation zones in the City and has identified 17 Potential Landmark Districts.

The proposed Zoning Amendment supports several Fullerton Plan Goals and Policies, including Goal 1, which supports resilient and vital neighborhoods and districts, Goal 2, which supports a positive identity and distinctive image, Goal 3, which supports a supply of safe housing ranging in cost and type to meet the needs of all segments of the community, and Goal 4, which supports valued and preserved historic resources.
3) The requested Zoning Amendment is compatible with other uses and zones in the area and will not be detrimental to the health, safety, and welfare of the surrounding neighborhood.

The proposed Zoning Amendment would apply to properties within the boundaries herein and would not change the underlying land use classification or Fullerton Plan designation for these properties, nor is construction or future development proposed. Therefore, the West Wilshire, Woods, and Wickett Square Neighborhood would remain compatible with the other uses and zones in the area and there would be no detrimental effect on the health, safety and welfare or surrounding neighborhoods.

ADOPTED BY THE FULLERTON LANDMARKS COMMISSION ON SEPTEMBER 11, 2024.
