FISCAL IMPACT
The annualized fiscal impact for Fiscal Year (FY) 2024-25 totals approximately $33,720. The prorated cost for the remainder of the FY total approximately $24,590 based on 700 hours. The Police Department FY 2024-25 Adopted Budget has sufficient funds to support the cost of this appointment.
BACKGROUND AND DISCUSSION
David Benedict will retire from the City Fullerton on December 6, 2024, after 17 years of service. Mr. Benedict is a Police Services Representative II serving as the Police Department rangemaster. The City desires to temporarily hire Mr. Benedict as a retired annuitant while the City conducts a recruitment to fill his position. The new Police Services Representative II will require a training period before becoming fully immersed in the department. The Department has an urgent need for an experienced staff member to assist with new employee training.
Public Employees’ Retirement Law (PERL), California Government Code Sections 21220 through 21230, allow a CalPERS retired annuitant to work without reinstatement from retirement or loss of interruption of benefits upon a finding that the retired annuitant has specialized skills needed to perform work on a limited duration and work no more than 960 hours a fiscal year. Government Code 7522.56 provides that a retired annuitant is eligible for post-retirement employment 180 days following his or her retirement date. The City may make an exception to the 180-day waiting period if the governing body adopts a resolution during a public meeting certifying the nature of the employment and the necessity to fill a critically needed position before 180 days has passed.
Mr. Benedict, as a Police Services Representative II serving as a Rangemaster, possess very specialized knowledge and skills and provides a vital service to the organization including:
maintaining the Police Department armory
providing firearms instructions and qualifications for staff members incorporating new and advanced training aids into existing programs reviewing department policies, procedures, laws, codes and like items relating to the use of force recommends changes as needed annually inspecting department-issued weapons
maintaining and repairing department-issued and authorized weapons, armory and range equipment including delivering and retrieving weapons for repair delivering confiscated, surrendered and other weapons and ammunition to destruction sites.
Approval of the proposed resolution waiving the CalPERS 180-day waiting period would authorize the City to rehire Mr. Benedict as a retired annuitant to serve in the Police Services Representative II position, at his retired pay rate for a period not to exceed one year and an annual maximum of 960 work hours. Mr. Benedict would provide a new Police Services Representative II with the necessary training and facilitate transition to succeed in this role.
