This memorandum serves as a supplemental errata to Chapter 3, Revisions to the Draft Program EIR, to the Final Program Environmental Impact Report (PEIR) presented to the City of Fullerton City Council on December 3, 2024.
In response to public comment and staff recommendations, the following describes the introduction of a new alternative to the proposed Program. Alternative 4, Sites Inventory Only, further reduces parcels within the Planning Area to align with the identified parcels selected in the Housing Element Sites Inventory. See Attachment 1 for a list of parcels and residential buildout projections.
Pursuant to CEQA Guidelines Section 15088.5, a lead agency is required to recirculate an EIR when significant new information is added to the EIR after public notice is given of the availability of the draft EIR but before certification.
Significant new information can include a disclosure showing that a new significant environmental impact would result from the project or from a new mitigation measure proposed to be implemented, a substantial increase in the severity of an environmental impact, a feasible project alternative or mitigation measure considerably different from others previously analyzed would clearly lessen the environmental impacts of the project (but the project’s proponents decline to adopt it), or the draft EIR was so fundamentally and basically inadequate and conclusory in nature that meaningful public review and comment were precluded. The proposed revisions under Alternative 4 do not constitute significant new information requiring recirculation of the PEIR as defined in CEQA Guidelines Section 15088.5. Instead, the this new alternative reduces the number of sites that could be redeveloped and merely presents a feasible project alternative to an adequate PEIR.
CEQA Guidelines Section 15126.6[a] requires that EIRs “describe a range of reasonable alternatives to the project, or to the location of the project, which would feasibly attain most of the basic objectives of the project but would avoid or substantially lessen any of the significant effects of the project, and evaluate the comparative merits of the alternatives.” Further reduction of parcels compared to the proposed Program would still meet each project objective. Additionally, removal of additional parcels would reduce the potential buildout of residential and commercial uses across the Planning Area; thus, the severity of impacts would be reduced . Alternative 4 is not anticipated to eliminate significant and unavoidable impacts identified in the proposed Program. No new significant environmental impacts or a substantial increase in the severity of environmental impacts would occur from these revisions.
