BACKGROUND AND DISCUSSION
David Benedict retired from the City Fullerton on December 7, 2024, after 17 years of service as a Police Services Representative II serving as the Police Department rangemaster. The City desires to temporarily hire Mr. Benedict as a retired annuitant while the City completes recruitment to fill his position. Mr. Benedict would not fill the Police Services Representative II position. He would assist preventing any business stoppage until the City fills the Police Services Representative II position. Mr. Benedict would maintain the extra help role following recruitment to train the new Police Services Representative II.

Public Employees’ Retirement Law (PERL), California Government Code Sections 21220 through 21230, allows a CalPERS retired annuitant to work without reinstatement from retirement or loss of interruption of benefits upon finding the retired annuitant has specialized skills needed to perform work for a limited duration and works no more than 960 hours in a fiscal year. California Government Code Section 7522.56 provides that a retired annuitant becomes eligible for post-retirement employment 180 days following his or her retirement date. An agency may make an exception to the 180-day waiting period if the governing body adopts a resolution during a public meeting certifying the nature of the employment and the need to fill a critically needed position before the 180 days has passed.

Mr. Benedict possess specialized knowledge and skills as a Police Services Representative II serving as rangemaster and provides a vital services including:
maintaining the Police Department armory
providing firearms instructions and qualifications for staff members incorporating new and advanced training aids into existing programs reviewing and recommending changes to department policies, procedures, laws, codes and like items conducting annual inspections of department-issued weapons providing maintenance and repair to department-issued and authorized weapons, armory and range equipment including delivering and retrieving weapons for repair delivering confiscated, surrendered and other weapons and ammunition to destruction sites.

The proposed resolution would waive the CalPERS 180-day waiting period and authorize rehiring Mr. Benedict as a retired annuitant serving as the Police Services Representative II position, at his retired rate of pay for a period not to exceed one year and an annual maximum number of 960 work hours. Mr. Benedict would also train the new Police Services Representative II and facilitate transition into this role.
