PRIORITY POLICY STATEMENT
This item matches the following Priority Policy Statements:
Infrastructure and City Assets.
FISCAL IMPACT
This item generates no additional fiscal impact to the City. All SCE facilities constructed within the SCE easement would have private ownership, maintained by SCE. The City would own and maintain the new sewer facilities located within dedicated easements. These facilities replace existing sewer facilities also owned and maintained by the City.
BACKGROUND AND DISCUSSION
City Council approved "The Hub," a student-oriented housing development with up to 377 units and ground-floor commercial space, at the northeast corner of Chapman and Commonwealth Avenues on January 18, 2022. Staff attached the resolutions City Council approved for reference (Attachment 1).
The project relocated an 8-inch City sewer main in conflict with the proposed development to a City-approved location and a new 20-foot-wide underground sanitary sewer easement dedicated to the City of Fullerton, as shown on Parcel Map No. 2020-173, recorded July 26, 2023 (Attachment 2).
SCE and Core Fullerton Chapman, LLC. installed electrical services within a portion of this sewer easement. Attachment 3 outlines the subject area in relation to the entire property. Staff evaluated alternative locations outside the sewer easement but found them unfeasible due to site constraints, limited power sources and SCE design standards.
The joint use agreement between SCE, the City and Core Fullerton Chapman, LLC. would allow SCE to locate facilities within the sewer easement to provide electrical services to the property (Attachment 4 and 5).
The joint use agreement specifies that SCE may temporarily relocate facilities if required for future maintenance or improvements to the City sewer main, with costs covered by the property owner. The agreement ensures both utilities coexist within the easement without impacting the City sewer infrastructure.
