UTION OF THE CITY COUNCIL OF THE CITY OF
FULLERTON, CALIFORNIA, APPROVING A SUMMARY VACATION TO
ABANDON A CITY OF FULLERTON SEWER EASEMENT OVER A
PORTION OF THE PROPERTY LOCATED AT THE NORTHEAST
CORNER OF CHAPMAN AND COMMONWEALTH AVENUES

THE CITY COUNCIL OF THE CITY OF FULLERTON RESOLVES AS
FOLLOWS:
1. City Council makes this summary vacation pursuant to California Streets and Highways Code Division 3, Part 3, Chapter 4, Sections 8334, 8335 and 8336.
2. The easement for sewer and appurtenant structures purposes to vacate is that portion of the land described in Grant of Easement recorded October 6, 1967 in Official Records of Orange County, California, Book 8396, Page 292 located on a portion of the northeast corner of Chapman and Commonwealth Avenues (2601-2751 East Chapman Avenue) and more particularly described in the attached Exhibit A and shown on Exhibit B and by reference made a part hereof.
3. The portion of the easement to vacate within the property described in the attached Exhibit A and shown on Exhibit B exceeds the City’s need for easements for sewer and appurtenant structures purposes. The City no longer uses that portion and removed and relocated utilities.
4. From and after the recorded date of this resolution, said portion of the easement within the property as described in the attached Exhibit A and shown on Exhibit B is vacated and no longer constitute s an easement for sewer and appurtenant structures purposes.
5. The City Clerk s hall record a certified copy of t he resolution of v acation, attested by the C ity Clerk under seal, without ac knowledgment, c ertificate of acknowledgment or further proof in t he office of the c ounty recorder. The vacation is complete upon such recordation.
