FISCAL IMPACT
This item generates no additional fiscal impact to the City. All streets, hardscape, landscape and irrigation, sewer, drainage, storm water quality facilities and lighting constructed within the boundary of the map would have private ownership and maintained by the homeowner’s association. The City would own and maintain new water facilities located within dedicated easements, however, these facilities replace existing water facilities which need facility maintenance.
BACKGROUND AND DISCUSSION
Tract No. 19148 (commonly referred to as The Pines at Sunrise Village) is located at 1715 / 1723 Euclid Street and 1701 / 1751 / 1801 - 1900 Euclid Street, generally bounded by Rosecrans Avenue on the north, Paseo Dorado on the south, Euclid Street on the east and Camino Loma on the west, as shown on Attachment 2. The site was previously developed as a commercial site but is now being developed to provide residential housing and commercial buildings.
The Final Map creates a residential and commercial subdivision with two lots for condominium purposes and three lots for commercial purposes. The development has access points from Camino Loma, Euclid Street and Rosecrans Avenue.
City Council approved the General Plan Revision, Major Site Plan, Tentative Tract Map and Mitigated Negative Declaration for the development on January 3, 2023. Staff attached the resolutions City Council adopted for reference (Attachment 3).
The staff has check the Final Map and it substantially conforms with the approved Tentative Tract Map and conforms with the Subdivision Map Act and Fullerton Municipal Code Title 16. The subdivider, Sunrise Village Owner LLC, a limited liability corporation, posted the necessary Subdivision Agreement (Attachment 4), bonds and cash fees.
An existing City easement for public water and incidental purposes traverses the project site, from Rosecrans Avenue to Paseo Dorado which was conveyed to the City in 1976 (as Book No. 11718, Page No. 1529 of Official Records). Staff recommends vacating this easement because the public water line has relocated. Part of this final map approval would establish a new water easement from Rosecrans Avenue through the project site to Euclid Street. State law mandates relinquishing easements not used for the intended purposes and/or will not have future use. Streets and Highways Code Section 8333 allows processing a summary abandonment vacating the subject portion of the existing easement for water line and incidental purposes as a new water easement (dedicated on the new tract map) has superseded the existing easement and no other public facilities are located within said easement.
