Dear Russell Hildebrand:
RE: HCD’s Review of the City of Fullerton’s Resolution No. 2023-031 Declaring the Remnant Right-of-Way Located East of 1747 West Commonwealth Avenue as “Exempt Surplus Land”
Thank you for notifying the California Department of Housing and Community Development (HCD) of the City of Fullerton’s (City) determination of the remnant right-of- way located east of 1747 West Commonwealth Avenue (Property), as “exempt surplus land.”
HCD reviewed Resolution No. 2023-031 (Resolution) and supporting written findings pursuant to Section 400 of the Surplus Land Act Guidelines. As explained below, HCD finds that the Property qualifies as “exempt surplus land” under Government Code section 54221, subdivision (f)(1)(E).
Analysis
According to the Resolution and supporting written findings, the Property is a former right- of-way. The City intends to sell the Property to Grace Ministries International, the owner of an adjacent property.
Conclusion
Based on our review of the documentation provided and application of the law, the Property qualifies as “exempt surplus land” under Government Code section 54221, subdivision (f)(1)(E). The City is permitted to proceed with the sale of the Property as described in the Resolution.
