CITY OF FULLERTON
AMENDMENT NUMBER ONE TO THE MAINTENANCE SERVICES AGREEMENT WITH JOHN L. HUNTER AND ASSOCIATES (JLHA) THIS AMENDMENT NUMBER ONE ("Amendment") to the Professional Services Agreement is made and entered on this _____ day of March 2026 (“Effective Date”) by and between the CITY OF FULLERTON ("City"), and John L. Hunter and Associates (JLHA) (“Contractor”).
RECITALS
WHEREAS, the City and Contractor entered into the Agreement on July 1, 2020 to perform professional stormwater consulting services for the City of Fullerton.
WHEREAS, the Agreement with the Contractor is set to expire on June 30, 2026.
WHEREAS, the City is tentatively scheduled for a stormwater regulatory audit with the California State Water Resources Control Board (SWRCB).
WHEREAS, the City requests this Amendment to add an additional year to the existing Agreement to ensure coverage during the regulatory audit process and continuation of the storm water program.
NOW, THEREFORE, for and in consideration of the mutual covenants and conditions contained herein, the parties hereby agree as follows:
The term of the Agreement is extended to June 30, 2027.
Contractor shall continue to be compensated at the approved rate in place of the Effective Date of this Amendment.
All terms not defined herein shall have the same meaning and use as set forth in the Agreement, as amended.
Except as set forth in this Amendment, all terms and provisions of the Agreement and all amendments shall remain in full force and effect.
This Amendment may be executed in one or more counterparts, each of which shall be deemed an original. All counterparts together with the Agreement and Amendment One shall constitute one agreement.
IN WITNESS WHEREOF, the parties hereto have caused this Amendment to be executed by and through their respective authorized officers.
