CITY OF FULLERTON
AMENDMENT NUMBER ONE TO THE PROFESSIONAL SERVICES AGREEMENT WITH
HF&H CONSULTANTS, LLC
THIS AMENDMENT NUMBER ONE (“Amendment”) to the Professional Services Agreement is made and entered into this 1st day of May 2026 by and between the CITY OF FULLERTON (“City”), and HF&H Consultants, LLC (“Consultant”).
RECITALS
A. WHEREAS, the City and Contractor entered into the Agreement on May 1, 2025 to perform solid waste consulting services in the City of Fullerton.
B. WHEREAS, the City Manager, under the purchasing authorization limit, approved a professional services agreement with HF&H Consultants, LLC for the period of May 1, 2025 through April 30, 2026 to support Senate Bill 1383 (SB 1383 ) program implementation, compliance efforts, program expansion, and assistance related to the City’s CalRecycle SB 1383 Corrective Action Plan.
C. WHEREAS, the City remains committed to meeting all state -mandated regulatory requirements, and requires continued solid waste consulting services to ensure full SB 1383 program implementation, future program expansion, and readiness for forthcoming legislative requirements.
D. WHEREAS, the City requires and extended Solid Waste, Recycling, and Organics Consutant Services of up to one (1) fiscal year
NOW, THEREFORE, for and in consideration of the mutual covenants and conditions contained herein, the parties hereby agree as follows:
1. The term of the Agreement is extended to June 30, 2027.
2. Effective May 1, 2026, Contractor shall be compensated in accordance with the fee amounts set forth in Exhibit A (“ HF&H Consultants, LLC Proposal”) in consideration of the term extension and Contractor’s outlined Scope of Work . These rates shall remain in effect for the duration of the extended term unless amended in writing by both parties.
3. All terms not defined herein shall have the same meaning and use as set forth in the Agreement, as amended.
4. Except as set forth in this Amendment, all terms and provisions of the Agreement and all amendments shall remain in full force and effect.
5. This Amendment may be executed in one or more counterparts, each of which shall be deemed an original. All counterparts together with the Agreement , and Amendment One shall constitute one agreement.
